S T A T E O F N E W Y O R K ________________________________________________________________________ 11502 I N A S S E M B L Y June 17, 2010 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Glick) -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to requiring that certain New York citizens who have been discharged from the armed forces or the national guard be provided with a copy of their certif- icates without charge THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 4174 of the public health law, as separately amended by chapters 409 and 698 of the laws of 1978, is amended to read as follows: 4. (A) No fee shall be charged for a search, certification, certif- icate, certified copy or certified transcript of a record to be used for school entrance, employment certificate or for purposes of public relief or when required by the veterans administration to be used in determin- ing the eligibility of any person to participate in the benefits made available by the veterans administration or when required by a board of elections for the purposes of determining voter eligibility. (B) NO FEE SHALL BE CHARGED TO ANY CITIZEN OF NEW YORK STATE WHO HAS BEEN DISCHARGED FROM THE ARMED FORCES OR THE NATIONAL GUARD WITH AN HONORABLE DISCHARGE OR WITH A GENERAL DISCHARGE WITH HONORABLE CONDI- TIONS FOR A SEARCH, CERTIFICATION, CERTIFICATE, CERTIFIED COPY OR CERTI- FIED TRANSCRIPT OF HIS OR HER BIRTH CERTIFICATE. FOR PURPOSES OF THIS PARAGRAPH, A DISCHARGE BASED SOLELY ON "HOMOSEXUAL CONDUCT" SHALL BE CONSIDERED TO BE A GENERAL DISCHARGE. S 2. This act shall take effect immediately.
