DESTITO, SCHROEDER -- read once and referred to the Committee on Mental Health, Mental Retardation and Developmental Disabilities AN ACT to amend the mental hygiene law, in relation to the appointment of directors of community services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (a) of section 41.09 of the mental hygiene law, as amended by chapter 588 of the laws of 1973 and such section as renum- bered by chapter 978 of the laws of 1977, is amended to read as follows: (a) [Charter] LOCAL governments may provide for appointment and removal of directors in a manner authorized by such governments. [In all other local governments, the board shall appoint and remove the direc- tor.] Salaries and allowable expenses shall be set by the appointing authority. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD01299-01-9
