BILL NUMBER: S4199 TITLE OF BILL : An act to amend the education law, in relation to the board of trustees of the higher education services corporation PURPOSE OF THE BILL : This bill would amend Article 14 of the Education Law to eliminate the requirement that the community college student member appointed by the Governor to the New York State Higher Education Services Corporation's (HESC) Board of Trustees be confirmed by the Senate. SUMMARY OF PROVISIONS : Section 1 of the bill eliminates the requirement that the community college student member appointed to HESC's Board of Trustees by the Governor receive Senate confirmation. Section 2 of the bill provides for an immediate effective date. EXISTING LAW : Currently, the community college student member appointed to the HESC Board of Trustees requires Senate confirmation. PRIOR LEGISLATIVE HISTORY : This is a new bill.

STAVISKY -- (at request of the Higher Education Services Corporation) -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to the board of trustees of the higher education services corporation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 3 and 4 of section 652 of the education law, subdivision 3 as amended by chapter 653 of the laws of 2004, subdivision 4 as amended by chapter 297 of the laws of 1997, are amended to read as follows: 3. The corporation shall be governed and all of its corporate powers exercised by a board of trustees which shall consist of fifteen members, [ten] NINE of whom shall be appointed by the governor with the advice and consent of the senate[, three of whom]. THE MEMBERS NOT REQUIRING THE ADVICE AND CONSENT OF THE SENATE shall be the commissioner of educa- tion, the chancellor of the state university, the chancellor of the city university of the city of New York, and [four of whom shall be] THREE students. One such student shall be the president of the student assem- bly of the state university of New York, one such student shall be the chair of the united student senate of city university of New York, [one such student shall be a student currently registered and in full time attendance at a degree granting independent institution of higher educa- tion in New York,] and one such student shall be a student registered in a full time course of study at a state university community college. In the event a student who shall be a member by reason of his or her office in a student organization shall fail to qualify, the student who holds the next highest office in the organization shall be the member of the board. 4. All members shall be at least eighteen years of age, citizens of the United States and residents of the state.
