TITLE OF BILL :
An act in relation to authorizing the commissioner of environmental
conservation to undertake projects to protect the Montauk Lighthouse
from shore erosion


PURPOSE OR GENERAL IDEA OF BILL :
This legislation would allow the Department of Environmental
Conservation to undertake certain projects to protect the Montauk
Lighthouse, which is owned by the Montauk Historical Society, Inc., a
not-for-profit corporation.

SUMMARY OF SPECIFIC PROVISIONS :
This is a special act authorizing the Department of Environmental
Conservation to undertake any project to protect the Montauk
Lighthouse from shore erosion, notwithstanding any other laws to the
contrary. It makes no determination as to the best method to undertake
such protection.

JUSTIFICATION :
The Montauk Lighthouse is a historically significant site on the east
end of Long Island. Unfortunately, the area is seriously threatened by
erosion.

The Department of Environmental Conservation is a partner with other
levels of government to protect the Montauk Lighthouse, but State law
does not allow a State agency to enter into this type of agreement
with a not-for-profit corporation.

This legislation would allow such an agreement to protect the
lighthouse.
