BILL NUMBER: S269 TITLE OF BILL : An act to amend the town law, in relation to authorizing the designation of hamlets upon consolidation of two or more towns PURPOSE : To allow for the preservation of a community's identity when two local governments merge. SUMMARY OF PROVISIONS : Section 1 - adds a new subdivision to section 79-b of the town law to define hamlet as a geographic designation within a new town which identifies the boundaries of one or more former towns which consolidated to form the new town Section 2 - adds a new subdivision to section 79-d of the town law to allow the town boards of the several towns in the same county to include the designation of hamlets in a proposition for consolidation Section 3 - adds a new subdivision to section 79-e of the town law law to add the designation of hamlets within the new town and boundaries of such hamlet Section 4 - contains the effective date

LITTLE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the town law, in relation to authorizing the designation of hamlets upon consolidation of two or more towns THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 79-b of the town law is amended by adding a new subdivision 5 to read as follows: 5. HAMLET. A GEOGRAPHIC DESIGNATION WITHIN A NEW TOWN WHICH IDENTIFIES THE BOUNDARIES OF ONE OR MORE FORMER TOWNS WHICH CONSOLIDATED TO FORM THE NEW TOWN. S 2. Section 79-d of the town law is amended by adding a new subdivi- sion 1-a to read as follows: 1-A. THE TOWN BOARDS OF THE SEVERAL TOWNS IN THE SAME COUNTY MAY INCLUDE THE DESIGNATION OF HAMLETS IN A PROPOSITION FOR CONSOLIDATION. S 3. Section 79-e of the town law is amended by adding a new subdivi- sion 1-a to read as follows: 1-A. THE DESIGNATION OF ANY HAMLETS WITHIN THE NEW TOWN AND THE BOUND- ARIES OF SUCH HAMLET; S 4. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD00256-01-9
