  printed to be committed to the Committee on Civil Service and Pensions

AN ACT to amend the civil service law, in relation to  the  duration  of
  probationary  periods  and disciplinary hearings for certain employees
  in the non-competitive class

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The opening paragraph and paragraph (e) of subdivision 1 of
section  75  of  the civil service law, the opening paragraph as amended
and paragraph (e) as added by chapter 842  of  the  laws  of  1985,  are
amended and a new paragraph (f) is added to read as follows:
  A  person  described  in  paragraph (a) or paragraph (b), or paragraph
(c), or paragraph (d), or paragraph (e), OR PARAGRAPH (F) of this subdi-
vision shall not be removed or otherwise subjected to  any  disciplinary
penalty  provided  in this section except for incompetency or misconduct
shown after a hearing upon stated charges pursuant to this section.
  (e) an employee in the service of a police department within the state
of New York holding the position of detective  for  a  period  of  three
continuous years or more; provided, however, that a hearing shall not be
required  when  reduction  in rank from said position is based solely on
reasons  of  the  economy,  consolidation  or  abolition  of  functions,
curtailment of activities or otherwise[.], OR
  (F)  NOTWITHSTANDING  ANY OTHER PROVISION OF THIS SECTION OR ANY OTHER
LAW, RULE OR REGULATION TO THE CONTRARY, AN EMPLOYEE OF THE  HEALTH  AND
HOSPITALS CORPORATION OF THE CITY OF NEW YORK IN A TITLE IN THE NON-COM-
PETITIVE CLASS WHO HAS COMPLETED AT LEAST ONE YEAR OF CONTINUOUS SERVICE
IN HIS OR HER CURRENT TITLE.
  S 2. This act shall take effect immediately.
