CRESPO -- read once and referred to the Committee on Ways and Means AN ACT to amend the tax law, in relation to establishing the New York office of natural resource revenue THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The tax law is amended by adding a new article 42 to read as follows: ARTICLE 42 NEW YORK OFFICE OF NATURAL RESOURCE REVENUE SECTION 4000. NEW YORK OFFICE OF NATURAL RESOURCE REVENUE. 4001. DEFINITIONS. 4002. POWERS AND DUTIES OF THE OFFICE. 4003. ANNUAL REPORT. S 4000. NEW YORK OFFICE OF NATURAL RESOURCE REVENUE. THERE IS HEREBY CREATED WITHIN THE DEPARTMENT THE NEW YORK OFFICE OF NATURAL RESOURCE REVENUE. THE HEAD OF THE NEW YORK OFFICE OF NATURAL RESOURCE REVENUE SHALL BE THE COMMISSIONER. SUCH COMMISSIONER, SUBJECT TO RULES PRESCRIBED BY THE GOVERNOR, MAY ESTABLISH SUCH BUREAUS OR DIVISIONS IN THE NEW YORK OFFICE OF NATURAL RESOURCE REVENUE, AS HE OR SHE MAY DEEM NECESSARY AND MAY APPOINT SUCH DEPUTIES, DIRECTORS, ASSISTANTS AND OTHER EMPLOYEES AS MAY BE NEEDED FOR THE PERFORMANCE OF HIS OR HER DUTIES AND MAY PRESCRIBE THEIR POWERS AND DUTIES AND FIX THEIR COMPENSATION WITHIN THE AMOUNT APPROPRIATED THEREFOR. SUCH OFFICE SHALL BE FULLY ESTABLISHED WITHIN ONE HUNDRED TWENTY DAYS FROM THE EFFECTIVE DATE OF THIS ARTICLE. S 4001. DEFINITIONS. FOR PURPOSES OF THIS ARTICLE, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: 1. "ROYALTIES" SHALL MEAN THE AMOUNTS PAID BY A PRODUCER TO A LANDOWN- ER FOR THE RIGHT TO DEVELOP LAND BY EXTRACTING OIL, NATURAL GAS AND/OR OTHER MINERALS, FROM THE AMOUNTS THE PRODUCER ACTUALLY RECEIVES FROM SALE OF SUCH OIL, NATURAL GAS AND/OR OTHER MINERALS.
