Enacts the food allergen information toll-free number act; requires certain manufacturers, packers or distributors to label their products with a toll-free telephone number to provide information to the consumer regarding the product's ingredients; requires other manufacturers, packers, or distributors to label their products with an e-mail or mailing address.

AN ACT to amend the agriculture and markets law, in relation to enacting
  the "food allergen information toll-free number act"

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Short title. This act shall be known and may  be  cited  as
the "food allergen information toll-free number act".
  S  2.  Section  201  of  the agriculture and markets law is amended by
adding a new subdivision 15 to read as follows:
  15. IF, IN THE CASE OF A MANUFACTURER,  PACKER  OR  DISTRIBUTOR  WHOSE
ANNUAL  GROSS  SALES  IN  THIS STATE OR WHOSE SALES TO CONSUMERS IN THIS
STATE EQUAL OR EXCEED FIVE HUNDRED THOUSAND DOLLARS, THE FOOD PACKAGE IS
NOT  LABELED  WITH  SUCH  MANUFACTURER'S,  PACKER'S   OR   DISTRIBUTOR'S
TOLL-FREE  TELEPHONE  NUMBER.  SUCH  TOLL-FREE  NUMBER  SHALL BE STAFFED
DURING REASONABLE BUSINESS HOURS AND SHALL INCLUDE ONE TELEPHONE LINE TO
ACCOMMODATE TELECOMMUNICATIONS DEVICES FOR HEARING-IMPAIRED PERSONS.  IN
THE  CASE  OF SUCH A MANUFACTURER, PACKER OR DISTRIBUTOR WHOSE SALES ARE
LESS THAN FIVE HUNDRED THOUSAND  DOLLARS,  THE  FOOD  PACKAGE  SHALL  BE
LABELED  WITH  THE  MANUFACTURER'S,  PACKER'S OR DISTRIBUTOR'S E-MAIL OR
MAILING ADDRESS.
  S 3. This act shall take effect on the one hundred eightieth day after
it shall have become a law, provided  that  any  rules  and  regulations
necessary  to implement the provisions of this act on its effective date
are authorized and directed to be promulgated on or before  such  effec-
tive date.
