AN ACT to amend the correction law, in relation to prohibiting level two
  and level three sex offenders from entering or utilizing campgrounds

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The correction law is amended by adding a new section  168-
vv to read as follows:
  S 168-VV. PROHIBITION ON UTILIZING OR ENTERING CAMPGROUNDS. ANY PERSON
WHO  IS DESIGNATED A LEVEL TWO OR A LEVEL THREE SEX OFFENDER PURSUANT TO
SUBDIVISION SIX OF SECTION ONE HUNDRED SIXTY-EIGHT-L OF THIS ARTICLE  OR
ANY  PERSON  CONVICTED  OF  AN  OFFENSE IN ANY OTHER JURISDICTION WHO IS
REQUIRED TO REGISTER AS A SEX OFFENDER IN THE JURISDICTION IN WHICH  THE
CONVICTION  OCCURRED  SHALL BE PROHIBITED FROM ENTERING OR UTILIZING ANY
PRIVATE OR MUNICIPALLY-OWNED CAMPGROUND OR ANY CAMPGROUND THAT IS  OPER-
ATED  BY  THE  DEPARTMENT OF ENVIRONMENTAL CONSERVATION OR THE OFFICE OF
PARKS, RECREATION, AND HISTORICAL PRESERVATION. FOR THE PURPOSE OF  THIS
SECTION  CAMPGROUND SHALL MEAN ANY AREA DESIGNED FOR TRANSIENT OCCUPANCY
BY CAMPING IN TENTS, CAMP TRAILERS,  TRAVEL  TRAILERS,  MOTOR  HOMES  OR
SIMILAR FACILITY DESIGNED FOR TEMPORARY SHELTER.
  ANY  LEVEL TWO OF LEVEL THREE SEX OFFENDER, OR ANY PERSON CONVICTED OF
AN OFFENSE IN ANY OTHER JURISDICTION WHO IS REQUIRED TO  REGISTER  AS  A
SEX  OFFENDER  IN  THE JURISDICTION IN WHICH THE CONVICTION OCCURRED WHO
VIOLATES THIS SECTION SHALL BE GUILTY OF A CLASS A MISDEMEANOR UPON  THE
CONVICTION  FOR  THE FIRST OFFENSE, AND UPON THE CONVICTION FOR A SECOND
OR SUBSEQUENT OFFENSE SHALL BE GUILTY OF A CLASS E FELONY.
  S 2. This act shall take effect on the ninetieth day  after  it  shall
have become a law.
