BILL NUMBER:S2157 TITLE OF BILL: An act to amend the public health law, in relation to requiring the commissioner of health to create a list of long-term care contact information for the NY Connects: Choices for Long Term Care program PURPOSE OR GENERAL IDEA OF BILL: This bill would require the commis- sioner of health to compile a list of contact information for the NY Connects: Choices for Long Term Care program, local area agencies on aging, local departments of social services, and local departments of health and would require health care providers and practitioners to provide a patient who may be in need of long term care with such infor- mation based on the patient's county of residence. SUMMARY OF SPECIFIC PROVISIONS: Section 1 adds a new section, 2997-e, to the public health law, which would require the commissioner of health to create a list of contact information for the NY Connects: Choices for Long Term Care program, local area agencies on aging, local departments of social services, and local departments of health to be organized by county, provided that for New York city, such contact information for local agencies may be the government information and non-emergency services citizen service center. VALESKY, GRISANTI -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to requiring the commissioner of health to create a list of long-term care contact information for the NY Connects: Choices for Long Term Care program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2997-e to read as follows: S 2997-E. PROVISION OF CONTACT INFORMATION RELATING TO LONG TERM CARE. 1. THE COMMISSIONER SHALL, IN CONJUNCTION WITH THE STATE OFFICE FOR THE AGING, CREATE A LIST OF INFORMATION BY MEANS OF WHICH TO CONTACT THE NY CONNECTS: CHOICES FOR LONG TERM CARE PROGRAM ESTABLISHED PURSUANT TO SUBDIVISION EIGHT OF SECTION TWO HUNDRED THREE OF THE ELDER LAW, LOCAL AREA AGENCIES ON AGING, LOCAL DEPARTMENTS OF SOCIAL SERVICES, AND LOCAL DEPARTMENTS OF HEALTH TO BE ORGANIZED BY COUNTY, PROVIDED THAT IN A CITY WITH A POPULATION OF ONE MILLION OR MORE, SUCH CONTACT INFORMATION FOR LOCAL AGENCIES MAY BE THE GOVERNMENT INFORMATION AND NON-EMERGENCY SERVICES CITIZEN SERVICE CENTER IN SUCH CITY. THIS LIST SHALL BE UPDATED PERIODICALLY AS NEEDED. THE COMMISSIONER SHALL PROVIDE SUCH LIST TO HEALTH CARE PRACTITIONERS CERTIFIED OR LICENSED UNDER THIS CHAPTER AND, IN CONJUNCTION WITH THE COMMISSIONER OF EDUCATION, TO ALL HEALTH CARE PROVIDERS AND HEALTH CARE PRACTITIONERS LICENSED UNDER THE EDUCATION LAW. 2. WHENEVER A HEALTH CARE PROVIDER OR PRACTITIONER MAKES A RECOMMENDA- TION REGARDING THE NECESSITY OF LONG TERM CARE SERVICES OR A REFERRAL FOR THE RECEIPT OF LONG TERM CARE SERVICES TO A PATIENT, THE PATIENT OR PATIENT'S DESIGNATED REPRESENTATIVE SHALL BE PROVIDED BY THE HEALTH CARE PROVIDER OR PRACTITIONER THE CONTACT INFORMATION FROM THE LIST CREATED PURSUANT TO SUBDIVISION ONE OF THIS SECTION THAT CORRESPONDS TO THE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
