BILL NUMBER:S4287 TITLE OF BILL: An act to amend the private housing finance law, in relation to preferences under the affordable home ownership development program for service related disabled veterans PURPOSE OR GENERAL IDEA OF BILL: To give preference to a disabled veteran with a VA disability rating of 40% or higher the opportunity to get into an affordable home ownership program. SUMMARY OF SPECIFIC PROVISIONS: This legislation will make the Affordable Home Ownership Development Program available to home buyers who are service related disabled veterans. This legislation directs the Affordable Housing Corporation, when determining awards under the Affordable Rome Ownership Development Program, to provide a preference to applications based upon the extent to which the proposed project or program will serve households in which the home buyer is a disabled veteran, defined as those with a federal VA disability rating of 40% or higher. RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Security and Military Affairs AN ACT to amend the private housing finance law, in relation to prefer- ences under the affordable home ownership development program for service related disabled veterans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 3 of section 1112 of the private housing finance law, as amended by chapter 898 of the laws of 1986, is amended to read as follows: (a) Serve the lowest income households in the applicable region and is designed to continue to be affordable to such households for a substan- tial period of time[.] OR SERVE HOUSEHOLDS IN WHICH THE HOME BUYER IS A SERVICE RELATED DISABLED VETERAN. FOR PURPOSES OF THIS SECTION, "SERVICE RELATED DISABLED VETERAN" SHALL MEAN A PERSON (I) WHO SERVED IN THE ACTIVE MILITARY, NAVAL, OR AIR SERVICE DURING A TIME OF WAR AS DEFINED IN THIS PARAGRAPH, OR WHO WAS A RECIPIENT OF THE ARMED FORCES EXPEDITIONARY MEDAL, NAVY EXPEDITIONARY MEDAL, MARINE CORPS EXPEDITIONARY MEDAL, OR GLOBAL WAR ON TERRORISM EXPEDITIONARY MEDAL, AND WHO WAS DISCHARGED OR RELEASED THEREFROM UNDER HONORABLE CONDITIONS, (II) HAS BEEN AWARDED A DISABILITY RATING OF FORTY PERCENT OR HIGHER FROM THE FEDERAL VETERAN'S ADMINISTRATION OR FROM THE UNITED STATES DEPARTMENT OF DEFENSE, WHERE THAT DISABILITY WAS INCURRED IN LINE OF DUTY IN THE ACTIVE MILITARY, NAVAL OR AIR SERVICE, AS DOCU- MENTED ACCORDING TO RULES AND REGULATIONS TO BE PROMULGATED BY THE DIVI- SION. FOR THE PURPOSES OF THIS SECTION, "SERVICE DURING TIME OF WAR" SHALL MEAN: (I) THE INDIVIDUAL IN QUESTION WAS A RECIPIENT OF THE ARMED FORCES EXPEDITIONARY MEDAL, THE NAVY EXPEDITIONARY MEDAL OR THE MARINE CORPS EXPEDITIONARY MEDAL FOR PARTICIPATION IN OPERATIONS IN LEBANON FROM JUNE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
