BILL NUMBER:S6580 TITLE OF BILL: An act to amend the executive law and the general business law, in relation to enacting the "American made flag act of 2014" PURPOSE: To ensure that all American flags purchased for use in the State of New York are manufactured in the United States of America. SUMMARY OF PROVISIONS: Section one amends section 403 of the executive law to require that all American flags purchased for display in State buildings are 100 % made in the United States of America. Section two creates Article 12-C of the general business law to prohibit the selling of any American flags not made in the United States of America. Section three sets the enacting date. JUSTIFICATION: The American Flag is one of the most universally recognized symbols

MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law and the general business law, in relation to enacting the "American made flag act of 2014" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as the "American made flag act of 2014". S 2. Section 403 of the executive law is amended by adding a new subdivision 22 to read as follows: 22. ONLY FLAGS, REGARDLESS OF SIZE, THAT ARE ONE HUNDRED PERCENT MANU- FACTURED IN THE UNITED STATES, FROM ARTICLES, MATERIALS, OR SUPPLIES, ONE HUNDRED PERCENT OF WHICH ARE GROWN, PRODUCED OR MANUFACTURED IN THE UNITED STATES, MAY BE PURCHASED FOR USE BY THE STATE GOVERNMENT. S 3. The general business law is amended by adding a new article 12-C to read as follows: ARTICLE 12-C SALE OF FLAGS OF THE UNITED STATES OF AMERICA SECTION 220. SALE OF FLAGS OF THE UNITED STATES OF AMERICA. S 220. SALE OF FLAGS OF THE UNITED STATES OF AMERICA. NO PERSON IN THE BUSINESS OF OFFERING GOODS AT RETAIL MAY SELL OR OFFER FOR SALE IN THIS STATE A FLAG OF THE UNITED STATES OF AMERICA UNLESS THE FLAG WAS, REGARDLESS OF SIZE, ONE HUNDRED PERCENT MANUFACTURED IN THE UNITED STATES, FROM ARTICLES, MATERIALS, OR SUPPLIES, ONE HUNDRED PERCENT OF WHICH WERE GROWN, PRODUCED OR MANUFACTURED IN THE UNITED STATES. S 4. This act shall take effect on the one hundred eightieth day after it shall have become a law. Section two amends section 403 of the executive law to require that all American flags purchased for display in State buildings are 100% made in the United States of America. Section three sets the enacting date. JUSTIFICATION: The American Flag is one of the most universally recognized symbols representing the United States and the principles and freedoms upon which it was founded. It is estimated that New York spends nearly $3.6 million dollars every year on United States flags produced in other countries. This bill would ensure that all United States flags purchased by New York State are made in the United States.

ONLY FLAGS, REGARDLESS OF SIZE, THAT ARE ONE HUNDRED PERCENT MANUFACTURED IN THE UNITED STATES, FROM ARTICLES, MATERIALS, OR SUPPLIES, ONE HUNDRED PERCENT OF WHICH ARE GROWN, PRODUCED OR MANUFAC- TURED IN THE UNITED STATES, MAY BE PURCHASED FOR USE BY THE STATE GOVERNMENT. FOR THE PURPOSES OF THIS SUBDIVISION, THE TERM "FLAG" SHALL HAVE THE SAME MEANING AS PROVIDED IN SUBDIVISION ONE OF SECTION FOUR HUNDRED ONE OF THE EXECUTIVE LAW. S 3. Section 403 of the executive law is amended by adding a new subdivision 22 to read as follows: 22. ALL FLAGS PURCHASED AND DISPLAYED AT ANY PUBLIC BUILDING SHALL BE MADE IN THE UNITED STATES FROM AMERICAN MATERIALS, AS PROVIDED IN SUBDI- VISION NINE OF SECTION ONE HUNDRED SIXTY-FIVE OF THE STATE FINANCE LAW. S 4. This act shall take effect on the one hundred eightieth day after it shall have become a law.
