BILL NUMBER:S7340 TITLE OF BILL: An act to amend chapter 549 of the laws of 2013 amending the executive law and other laws relating to reform of charitable organizations, in relation to providing that the state shall develop certain procedures for the New York state grants gateway PURPOSE OR GENERAL IDEA OF BILL: To ensure that nonprofits who are registered with the NYS Grants Gateway are not disqualified or declared ineligible during the time when they are amending their applications or other required legal documents to conform with the provisions of the Non-profit Revitalization Act of 2013. SUMMARY OF SPECIFIC PROVISIONS: Section one would require the state to develop procedures to ensure that any nonprofit that is pre-qualified or registered with the Grants Gateway and that has submitted changes to their prequalification application to the state by January 1, 2015 will not be disqualified, suspended or prohibited from applying for or receiving state grants or contracts until such amendments have been disapproved. Section two states that this act shall take effect immediately. JUSTIFICATION: In 2013, the State established a NYS Grants Gateway to simplify and streamline the process for nonprofits to apply for state grants and contracts. RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Author- ities and Commissions AN ACT to amend chapter 549 of the laws of 2013 amending the executive law and other laws relating to reform of charitable organizations, in relation to providing that the state shall develop certain procedures for the New York state grants gateway THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Chapter 549 of the laws of 2013 amending the executive law and other laws relating to reform of charitable organizations is amended by adding a new section 130-a to read as follows: S 130-A. THE STATE SHALL DEVELOP PROCEDURES TO ENSURE THAT ANY NOT-FOR-PROFIT CORPORATION THAT IS PRE-QUALIFIED AND REGISTERED WITH THE NEW YORK STATE GRANTS GATEWAY AS OF THE EFFECTIVE DATE OF THIS SECTION, AND THAT HAS SUBMITTED TO THE GATEWAY OR TO THE STATE AGENCY RESPONSIBLE FOR OPERATING THE GATEWAY BY JANUARY 1, 2015, AMENDMENTS TO THEIR PREQUALIFICATION APPLICATION TO INCORPORATE THE PROVISIONS OF THIS CHAP- TER SHALL NOT BE DISQUALIFIED, SUSPENDED OR PROHIBITED FROM APPLYING FOR, RECEIVING, OR RENEWING STATE GRANTS OR CONTRACTS UNTIL AND UNLESS SUCH AMENDMENTS HAVE BEEN DISAPPROVED BY THE STATE. FOR THE PURPOSES OF THIS SECTION, THE TERM "NEW YORK STATE GRANTS GATEWAY" SHALL MEAN THE PROCESS DEVELOPED BY STATE, EFFECTIVE JULY 1, 2013, TO SIMPLIFY AND STREAMLINE THE PROCESSES FOR NOT-FOR-PROFIT CORPORATIONS TO APPLY FOR STATE GRANTS AND CONTRACTS.
