BILL NUMBER:S91 TITLE OF BILL: An act to amend the environmental conservation law, in relation to requiring the department of environmental conservation to issue documentation of hunter safety course completion PURPOSE: The purpose of this bill is to allow sportsmen and women who have previously completed the approved NYS DEC hunter safety course the ability to get a replacement certificate if it has been lost or destroyed without having to retake the hunter safety course. In order to get a hunting license in New York, an individual must product a valid hunter safety course certificate or a previous hunting license. The NYS DEC does not maintain records prior to 1980 which would provide a record of the individual's satisfactorily completing hunter safety course prior to 1980 should one be lost or destroyed. This bill would allow the NYS DEC to issue a replacement Hunter Safety Course Certificate based upon the individual possessing a current or expired NYS DEC issued hunting license. SUMMARY OF PROVISIONS: Amends Section 11-0713 of the environmental conservation law by adding a new subdivision 7.

Section 11-0713 of the environmental conservation law is amended by adding a new subdivision 7 to read as follows: 7. A PERSON WHO HOLDS A LICENSE OR STAMP AUTHORIZING THE HOLDER TO HUNT, FISH, OR TRAP AND WHO HAS LOST OR ACCIDENTALLY DESTROYED DOCUMEN- TATION DEMONSTRATING COMPLETION OF A HUNTER SAFETY COURSE AS REQUIRED TO OBTAIN SUCH A LICENSE OR STAMP MAY REQUEST THE DEPARTMENT TO PROVIDE DOCUMENTATION OF THE COMPLETION OF SUCH A HUNTER SAFETY COURSE. THE DEPARTMENT SHALL ISSUE A CERTIFICATE STATING THE NAME AND ADDRESS OF THE APPLICANT AND THAT THE APPLICANT HAS SATISFACTORILY COMPLETED A HUNTER SAFETY COURSE AS REQUIRED BY THE STATE OF NEW YORK TO OBTAIN A LICENSE OR STAMP AUTHORIZING THE HOLDER TO HUNT, FISH, OR TRAP. THE DEPARTMENT MAY CHARGE A REASONABLE FEE FOR THE ISSUANCE OF SUCH A CERTIFICATE. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Subdivision 4 of section 11-0713 of the environmental conservation law is amended by adding a new paragraph d to read as follows: D. A PERSON WHO HOLDS A LICENSE OR PRIVILEGE AUTHORIZING THE HOLDER TO HUNT, FISH, OR TRAP AND WHO HAS LOST OR ACCIDENTALLY DESTROYED DOCUMEN- TATION DEMONSTRATING COMPLETION OF A NEW YORK HUNTER SAFETY COURSE AS REQUIRED PURSUANT TO SUBDIVISION THREE OF THIS SECTION MAY APPLY FOR REPLACEMENT EDUCATION CERTIFICATES FOR A COMMISSION OF ONE DOLLAR TO THE ISSUING AGENT. THE DEPARTMENT SHALL ISSUE SUCH A DUPLICATE WHEN SATIS- FIED THE APPLICATION IS MADE IN GOOD FAITH. S 2. Paragraph c of subdivision 3 of section 11-0713 of the environ- mental conservation law, as amended by section 3 of part R of chapter 58 of the laws of 2013, is amended to read as follows: c. Certifications of qualification in responsible hunting, responsible bowhunting and responsible trapping practices may be made by duly quali- fied and designated persons, whose fitness to give instructions in said practices has been determined by an agent of the department.
