GALEF, PAULIN, PRETLOW -- read once and referred to the Committee on Local Governments AN ACT to amend the general municipal law, in relation to allowing the governing body of Westchester county to appoint a member of the West- chester county industrial development agency THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 923-a of the general municipal law, as amended by chapter 564 of the laws of 1983, is amended to read as follows: S 923-a. County of Westchester industrial development agency. For the benefit of the county of Westchester and the inhabitants thereof, an industrial development agency, to be known as the COUNTY OF WESTCHESTER INDUSTRIAL DEVELOPMENT AGENCY, is hereby established for the accomplish- ment of any or all of the purposes specified in title one of article eighteen-A of this chapter. It shall constitute a body corporate and politic, and be perpetual in duration. It shall have the powers and duties now or hereafter conferred by title one of article eighteen-A of this chapter upon industrial development agencies and provided that the exercise of the powers by such agency with respect to the acquisition of real property whether by purchase, condemnation or otherwise, shall be limited to the corporate limits of the county of Westchester and such agency shall take into consideration the local zoning and planning regu- lations as well as regional and local land use plans. The agency shall not use its funds to commence any project unless (i) at least thirty days' prior notice of such project shall have been given to each local municipality in which a part or parts of the project is, or is to be, located and (ii) no objection, by resolution of the governing body of such municipality, shall have been made and delivered to the agency within such thirty days. Notwithstanding the provisions of the next EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
