TITLE OF BILL: An act to amend chapter 719 of the laws of 1982,
relating to authorizing the commissioner of general services to convey
certain state lands in the county of Suffolk to the town of Islip, in
relation to exceptions for certain property

PURPOSE GENERAL IDEA OF BILL: Exempts a certain parcel of land from
stated restrictions of use so that the Town of Islip may transfer a 2
acre portion of the land to the Central Islip Fire Department for the
creation of a substation.

SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends section 7 of chapter 719 of the laws of 1982,
authorizing the Commissioner of General Services to convey certain
state lands in the county of Suffolk to the town of Islip, as amended
by chapter 269 of the laws of 2001. Further, it adds section 7-a which
establishes a parcel of land to be exempt from restrictions set forth
in section 7.

Section 2 sets an immediate effective date.

JUSTIFICATION: The law, as it currently stands, restricts the use of
this land and improvements thereon to purposes relating to education
and associated complements and to municipal corporations. Recognizing
the productive potential of the specified parcel of land, this
legislation aims to lift those restrictions so that the parcel may be
utilized to benefit the community through improvement of public safety
initiatives.

AN ACT to amend chapter 719 of the laws of 1982, relating to authorizing
  the commissioner of general services to convey certain state lands  in
  the  county of Suffolk to the town of Islip, in relation to exceptions
  for certain property

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  opening paragraph of section 7 of chapter 719 of the
laws of 1982,  relating  to  authorizing  the  commissioner  of  general
services  to  convey certain state lands in the county of Suffolk to the
town of Islip, as amended by chapter 269 of the laws of 2001, is amended
and a new section 7-a is added to read as follows:
  [Any] WITH THE EXCEPTION OF THE LAND DESCRIBED IN SECTION 7-A OF  THIS
ACT,  ANY land and improvements thereon transferred pursuant to this act
shall be used only by, or for the purposes  of  the  state,  the  United
States  of  America  and  its transferees or assigns, a municipal corpo-
ration or a  not-for-profit  college  or  university  chartered  by  the
regents  of  the  university  of  the  state of New York. Except for the
United States of America and its transferees or assigns, said  land  and
any  improvements  thereon  shall  be  used  only for hospital, park and
recreation, municipal office or educational purposes, and for complemen-
tary academic, scientific or technological uses,  applied  research  and
developmental  activities  of  a not-for-profit college or university, a
voluntary, municipal or state-operated hospital, or a  municipal  corpo-
ration.  Said  land  or any improvements thereon transferred pursuant to
this act to the United States of America or its transferees  or  assigns
shall not be designed or altered for the overnight housing and/or custo-
dy  of  prisoners or detainees. These purposes and/or restrictions shall
be recorded as deed covenants and restrictions  running  with  the  land
upon  the  transfer of the land to the town of Islip, Suffolk county and

its transferees or assigns.  Provided, however, that the commissioner of
general services, subject to the  approval  of  the  town  of  Islip  as
evidenced by a resolution of the town board and upon payment of fair and
reasonable  consideration as determined by said commissioner by New York
Institute of Technology to the office of general services, shall  amend,
modify or delete as set forth in said resolution any of the above stated
purposes, including the requirement that they be recorded as deed coven-
ants  and  restrictions  running  with  the  land  as  such purposes and
restrictions may appear in a conveyance to the town of Islip, its trans-
feree and assigns and apply to the following described five  parcels  of
land:
  S 7-A.  RESTRICTIONS PROVIDED IN SECTION 7 OF THIS ACT SHALL NOT APPLY
TO THE PARCEL OF LAND AS FOLLOWS:
  BEGINNING  AT  A POINT FORMED BY THE INTERSECTION OF THE WESTERLY SIDE
OF LOWELL AVENUE AND THE  SOUTHERLY  SIDE  OF  EASTVIEW  DRIVE;  RUNNING
THENCE  SOUTHERLY  ALONG  THE WESTERLY SIDE OF LOWELL AVENUE S07°39'38"E
300.00' TO A POINT; RUNNING THENCE WESTERLY  TO  THE  EASTERLY  SIDE  OF
EASTVIEW  DRIVE S82°13'18"W 356.55' TO A POINT OF THE CURVATURE; RUNNING
THENCE NORTHERLY ALONG THE EAST SIDE OF EASTVIEW DRIVE ALONG THE ARC  OF
A  CURVE  BEARING  TO THE RIGHT HAVING A RADIUS OF 455.93' AN ARC LENGTH
269.80' A CHORD DISTANCE OF 265.88 AND A CHORD BEARING OF N16°16'27"E TO
A POINT OF CURVATURE; RUNNING THENCE NORTHERLY ALONG THE  EAST  SIDE  OF
EASTVIEW  DRIVE  ALONG  THE ARC OF A CURVE BEARING TO THE RIGHT HAVING A
RADIUS OF 166.89' AN ARC LENGTH  OF  142.98'  AND  A  CHORD  BEARING  OF
N57°46'04"E  A CHORD DISTANCE OF 138.65' TO A POINT OF TANGENCY; RUNNING
THENCE EASTERLY ALONG THE  SOUTHERLY  SIDE  OF  EASTVIEW  DRIVE  TO  THE
WESTERLY SIDE OF LOWELL AVENUE N82°18'41"E 122.59' TO THE POINT OR PLACE
OF BEGINNING.
  S 2. This act shall take effect immediately.
