BILL NUMBER:S6124 TITLE OF BILL: An act in relation to legalizing, validating, ratifying and confirming a transportation contract of the Perry central school district PURPOSE: To amend the education law, in reference to certain acts of the Perry Central School District regarding a transportation contract for the 2013-2014 school year. SUMMARY OF PROVISIONS: Section 1 ratifies the Education law to legalize, validate, ratify, and confirm notwithstanding any failure to comply with the contract award. Section 2 directs the transportation aid as valid and proper. Section 3 requires that this act shall take effect immediately. JUSTIFICATION: The Perry Central School District followed proper procedure in completing transportation contracts for the 2013-2014 school year. Unfortunately, a school business official failed to submit one contract to the State Education Department (SED) in a timely manner. SED is unable to accept this contract because it was not filed on time. This legislation is necessary to enable SED to award this contract. This legislation is required for the school

GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT in relation to legalizing, validating, ratifying and confirming a transportation contract of the Perry central school district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. All the acts done and proceedings heretofore had and taken or caused to be had and taken by the Perry central school district and by all officers, employees or agents of such school district relating to or in connection with transportation contract E262090 of the 2013-2014 school year, and all acts incidental thereto are hereby legalized, vali- dated, ratified and confirmed, notwithstanding any failure to comply with the contract award, approval, and filing provisions of the educa- tion law, the general municipal law or any other law or any other statu- tory authority, rule or regulation, other than those filing provisions defined in paragraph a of subdivision 5 of section 3604 of the education law, in relation to any omission, error, defect, irregularity or ille- gality in such proceeding had and taken. S 2. The department of education is hereby directed to consider the aforementioned contract for transportation aid as valid and proper obli- gations of the Perry central school district. S 3.
