TITLE OF BILL: An act to amend the vehicle and traffic law, in relation
to metropolitan commuter transportation district registration fee
exemptions for farm vehicles

PURPOSE:

To remove the requirement that farm vehicles pay the metropolitan commu-
ter transportation district (MCTD) supplemental registration fee.

SUMMARY OF PROVISIONS:

Section one amends section 499-a of the vehicle and traffic law to state
that registrants of farm vehicles shall not be charged the MTA supple-
mental registration fee.

Section two amends section 499-b of the vehicle and traffic law to state
that registrants of farm vehicles shall not pay the MTA supplemental
registration fee.

Section three provides the effective date.

JUSTIFICATION:

Currently, registrants of farm vehicles who reside in the Metropolitan
Commuter Transportation District (City of New York and the Counties of
Dutchess, Nassau, Orange, Putnam, Rockland, Suffolk and Westchester)
must pay to the Commissioner of Motor Vehicles a supple- mental regis-
tration fee.

According to State law, farm vehicles are only allowed to travel between
points within New York State on public highways connecting portions of a
farm or farms, municipal sanitary landfills and licensed motor vehicle
repair shops, and may travel only by the most direct route, but in no
event further than 25 miles one-way. However, despite these tight
restrictions, farm vehicles must pay the supplemental fee like any other
registered vehicle in the MCTD.

The purpose of the MTA is not to provide transportation to farmers trav-
eling between farms and/or landfills. This fee places an undue burden on
our downstate farmers, who by virtue of where they live must pay the
supplemental fee, though they receive no supplemental services.

AN ACT to amend the vehicle and traffic law, in relation to metropolitan
  commuter transportation district registration fee exemptions for  farm
  vehicles

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 499-a of the vehicle and traffic law, as  added  by
section  1  of  part  B of chapter 25 of the laws of 2009, is amended to
read as follows:
  S 499-a. Metropolitan commuter  transportation  district  supplemental
registration  fee.  Registrants  residing  in  the metropolitan commuter
transportation district shall, upon the registration  or  renewal  of  a
motor  vehicle, be charged a supplemental registration fee to be paid to
the commissioner or his or her agent in accordance with  the  provisions
of  this article. A REGISTRANT SHALL NOT BE CHARGED A FEE FOR THE REGIS-
TRATION OR RENEWAL OF A FARM VEHICLE.
  S 2. Section 499-b of the vehicle and traffic law, as added by section
1 of part B of chapter 25 of the laws of 2009, is  amended  to  read  as
follows:
  S  499-b.  Collection  of  supplemental  fee. All registrants of motor
vehicles who reside in the metropolitan commuter transportation district
shall pay to the commissioner or  his  or  her  agent  the  supplemental
registration  fee  provided  for  in  this  article upon registration or
renewal of motor vehicles subject to registration fees pursuant  to  the
following  sections  of  this chapter: paragraph a of subdivision six of
section four hundred one; schedules A, B, C, E, F, G, I and K of  subdi-
vision  seven  of  section  four hundred one; paragraph a of subdivision
eight of section four hundred one; paragraph a of  subdivision  five  of
section  four  hundred  ten; and section four hundred eleven-b. A REGIS-
TRANT SHALL NOT PAY TO THE COMMISSIONER OR HIS OR HER AGENT A  FEE  UPON
REGISTRATION OR RENEWAL OF FARM VEHICLES.
  S 3. This act shall take effect immediately.
