BILL NUMBER:S7134

TITLE OF BILL: An act to amend the public officers law, in relation
to certain residency requirements

SUMMARY OF PROVISIONS:

Section one of the bill amends section 3 of the public officers law by
adding a new subdivision 62, providing that a person serving as a
member of the security force employed by Kaleida Health need not be a
resident of the political subdivision or municipal corporation within
which official functions are required to be exercised.

Section two of the bill is the effective date.

JUSTIFICATION:

This legislation would provide more flexibility in the employment or
appointment of members of the security force employed by Kaleida
Health. Under current law, members of the security force employed by
Kaleida Health are designated as peace officers. As such, these
individuals are subject to restrictions on their residency. These
restrictions can create difficulties in recruiting and retaining
individuals to serve in this important safety capacity. Allowing
Kaleida Health to accept individuals from neighboring counties to
serve in this role will help resolve this problem and further ensure
the safety of patients, visitors and employees.

  ment Operations

AN ACT to amend the public officers law, in relation to certain residen-
  cy requirements

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 3 of the public officers law is amended by adding a
new subdivision 62 to read as follows:
  62.  NEITHER THE PROVISIONS OF THIS SECTION OR OF ANY GENERAL, SPECIAL
OR LOCAL LAW, CHARTER, CODE, ORDINANCE, RESOLUTION, RULE OR  REGULATION,
REQUIRING  A  PERSON  TO  BE  A RESIDENT OF THE POLITICAL SUBDIVISION OR
MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE SHALL BE CHOSEN OR WITH-
IN WHICH HIS OFFICIAL FUNCTIONS ARE  REQUIRED  TO  BE  EXERCISED,  SHALL
APPLY  TO  THE  APPOINTMENT  OF A PERSON WHO IS A MEMBER OF THE SECURITY
FORCE  EMPLOYED  BY  KALEIDA  HEALTH   AS   DESCRIBED   IN   SUBDIVISION
EIGHTY-THREE  OF  SECTION  2.10  OF THE CRIMINAL PROCEDURE LAW, PROVIDED
THAT SUCH PERSON RESIDES IN THE COUNTY IN WHICH SUCH SECURITY  FORCE  OF
KALEIDA HEALTH IS LOCATED OR AN ADJOINING COUNTY WITHIN THE STATE.
