BILL NUMBER:S3636 TITLE OF BILL: An act to amend the county law, in relation to allowing Ontario county to participate in the Foreign Trade Zone program PURPOSE OR GENERAL IDEA OF BILL: Authorizes the county of Ontario to apply to the federal government to establish, operate and maintain a foreign trade zone or zones and foreign trade sub-zone or sub-zones within such county, and adjacent counties of Livingston, Wayne, Seneca, Yates, and Steuben. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Amends Section 224 of the County Law by adding a new subdivision 28 to allow for the County of Ontario, through its Ontario Economic Development Corporation, to make application to the Foreign Trade Zones Board established by Congress. Section 2. Contains the effective date. JUSTIFICATION: Numerous companies within Ontario County expressed inter- est in having access to Foreign Trade Zone (FTZ) benefits. The Ontario County Economic Development Corporation (OCEDC) recognized the need for FTZ status in Ontario County by passing a resolution to apply for FTZ grantee status under an Alternative Site Framework (ASF) on August 21, 2012. THE COUNTY OF ONTARIO, THROUGH ITS ONTARIO ECONOMIC DEVELOPMENT CORPORATION MAY MAKE APPLICATION TO THE FOREIGN TRADE ZONES BOARD ESTAB- LISHED BY THE ACT OF CONGRESS, APPROVED JUNE EIGHTEENTH, NINETEEN HUNDRED THIRTY-FOUR, ENTITLED "AN ACT TO PROVIDE FOR THE ESTABLISHMENT, OPERATION AND MAINTENANCE OF FOREIGN TRADE ZONES IN PORTS OF ENTRY OF THE UNITED STATES, TO EXPEDITE AND ENCOURAGE FOREIGN COMMERCE, AND FOR OTHER PURPOSES," FOR A GRANT TO ONTARIO COUNTY ECONOMIC DEVELOPMENT CORPORATION OF THE PRIVILEGE TO HAVE ESTABLISHED, OPERATED AND MAIN- TAINED A FOREIGN TRADE ZONE OR ZONES AND FOREIGN TRADE SUB-ZONE OR SUB- ZONES WITHIN SUCH COUNTY, AND ADJACENT COUNTIES OF LIVINGSTON, WAYNE, SENECA, YATES AND STEUBEN PURSUANT TO THE PROVISIONS OF SUCH ACT, AND IF SUCH APPLICATION BE GRANTED, TO HAVE ESTABLISHED, OPERATED AND MAIN- TAINED SUCH ZONE OR SUB-ZONE IN ACCORDANCE WITH LAW. THE ONTARIO ECONOM- IC DEVELOPMENT CORPORATION MAY ENTER INTO SUCH CONTRACTS AND MAY APPRO- PRIATE SUCH SUMS OF MONEY AS IT MAY DEEM PROPER, SUBJECT TO THE PROVISIONS OF THIS ARTICLE, TOWARDS THE PROMOTION AND ESTABLISHMENT OF SUCH ZONES.
