BILL NUMBER:S5822 TITLE OF BILL: An act relating to the cost allowance used to compute aid for capital improvement projects for the South Country central school district PURPOSE OR GENERAL IDEA OF BILL: This bill would restore $1,17 Million in building aid to the South Country Central School District (CSD). SUMMARY OF SPECIFIC PROVISIONS: Restores $1.17 million in building aid to the South Country CSD in relation to certain green energy projects. JUSTIFICATION: The South Country CSD made green energy improvements to school district buildings in the form of solar power installations (six projects in all). The goal was two-fold: The district was fulfilling the wishes of the community, which had approved a bond for the purpose, "to go green," and the district would realize savings from the effort for the community in the form of incentives through LIPA's Solar Pioneer Program. The incentives and savings, however, were nullified when the State Education Department reduced building aid for the six projects by a total of $1.17. The South Country CSD was not aware that these reductions would occur at the time they contracted for the improvements.

ZELDIN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT relating to the cost allowance used to compute aid for capital improvement projects for the South Country central school district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the aggregate amount of one million one hundred seventy thousand ($1,170,000) dollars received by the South Country central school district from the Long Island Power Authority Solar Pioneers program allocated among capital improvement projects designated by the state education department as project numbers 0002-009, 0003-009, 0004-011, 0005-009, 0006-009, and 0007-009 shall not be deducted from the cost allowance used to compute aid for such projects pursuant to subdivision 6 of section 3602 of the education law. Any amount due and payable to the South Country central school district for school years prior to the 2013-14 school year as a result of this act shall be paid pursuant to the provisions of paragraph c of subdivision 5 of section 3604 of the education law.
