MAGNARELLI -- read once and referred to the Committee on Higher Education AN ACT to amend the public health law, in relation to the reimbursement of tuition, fees and charges to state university health care facili- ties THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2807-aa to read as follows: S 2807-AA. STATE UNIVERSITY HEALTH CARE FACILITIES; REIMBURSEMENT OF TUITION, FEES AND CHARGES. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, ANY FUNDS COLLECTED AND RECEIVED BY THE STATE COMPTROLLER OR THE ATTOR- NEY GENERAL FOR PAST DUE AND UNCOLLECTED TUITION, FEES OR CHARGES DUE AND OWED TO A STATE UNIVERSITY HEALTH CARE FACILITY SHALL BE REIMBURSED AND PAID TO THE STATE UNIVERSITY HEALTH CARE FACILITY FOR WHICH SUCH UNCOLLECTED TUITION, FEES OR CHARGES WERE PAST DUE AND UNCOLLECTED. SUCH FUNDS, WHEN RECEIVED BY THE STATE COMPTROLLER OR THE ATTORNEY GENERAL, SHALL BE PAID TO SUCH UNIVERSITY HEALTH CARE FACILITY WITHIN THIRTY DAYS OF RECEIPT. FOR PURPOSES OF THIS SECTION THE TERM "STATE UNIVERSITY HEALTH CARE FACILITY" SHALL MEAN A HOSPITAL, AS DEFINED IN SECTION TWEN- TY-EIGHT HUNDRED ONE OF THIS ARTICLE, OPERATED BY THE STATE UNIVERSITY. S 2. This act shall take effect immediately and shall apply to past due and uncollected tuition, fees and charges collected on or after such date. Subdivision 3 of section 91-a of the state finance law, as added by chapter 55 of the laws of 1992, is amended to read as follows: 3. Within such account there shall be created a sub-account from which the comptroller, upon certification, may pay any refunds or reimburse- ments and any interest due thereon to which a debtor, as defined in section eighteen of this chapter, is entitled. ANY OVERPAYMENT CREDITED AGAINST OUTSTANDING DEBTS TO A STATE UNIVERSITY HEALTH CARE FACILITY, AS DEFINED IN SUBDIVISION FIVE OF SECTION THREE HUNDRED FIFTY OF THE EDUCA- TION LAW, AND COLLECTED ACCORDING TO SECTION ONE HUNDRED SEVENTY-ONE-F OF THE TAX LAW, SHALL BE DEPOSITED INTO SUCH SUB-ACCOUNT AND WITHIN THIRTY DAYS SUCH FUNDS SHALL BE MADE AVAILABLE TO THE STATE UNIVERSITY HEALTH CARE FACILITY OWED SUCH OUTSTANDING DEBT OR DEBTS. S 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
