Relates to the presentment of flags which were lowered to half-staff in memorial of the death of any police officer or peace officer; establishes that the commissioner of the division of criminal justice services, with the office of general services, shall arrange for the procurement and presentment of flags that were flown at half-staff in memorial of the death of any police officer or peace officer to the person designated to dispose of the remains of the officer.

BILL NUMBER:S5616 TITLE OF BILL: An act to amend the executive law, in relation to the presentment of flags which were lowered to half-staff in memorial of the death of any police officer or peace officer PURPOSE:This bill would provide for the presentment of flags which were lowered at half-staff in memorial of the death of any police officer or peace officer SUMMARY OF PROVISIONS: This bill adds a new Section 845-a to the Executive Law: it provides that, in the event the Governor orders the U.S. and N.Y.S. flags to be lowered to half- staff, in memorial of the death of any police officer or peace officer identified in the central state registry of police officers and peace officers, the flags lowered over the State Capitol shall be offered, without cost, to the person designated to dispose of the remains of such officer. JUSTIFICATION: This bill would provide a measure of recognition, honor and respect for a police officer or peace officer killed in the line of duty. On occasion, the Governor of the State has marked these tragic incidents by having the flags lowered at the Capitol in memory of the deceased officer. This legislation would provide for these flags to be offered for presentment to the next of kin of such officer. FARLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to the presentment of flags which were lowered to half-staff in memorial of the death of any police officer or peace officer THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 845-a to read as follows: S 845-A. PRESENTMENT OF FLAGS LOWERED TO HALF-STAFF IN MEMORIAL OF THE DEATH OF ANY POLICE OFFICER OR PEACE OFFICER. IN THE EVENT THE GOVERNOR ORDERS THE FLAGS OF THE UNITED STATES AND THE STATE OF NEW YORK TO BE LOWERED TO HALF-STAFF, IN MEMORIAL OF THE DEATH OF ANY POLICE OFFICER OR PEACE OFFICER IDENTIFIED IN THE CENTRAL STATE REGISTRY OF POLICE OFFI- CERS AND PEACE OFFICERS ESTABLISHED PURSUANT TO SECTION EIGHT HUNDRED FORTY-FIVE OF THIS ARTICLE, THE COMMISSIONER SHALL, IN COOPERATION WITH THE OFFICE OF GENERAL SERVICES, ARRANGE FOR THE PROCUREMENT OF A FLAG OF THE UNITED STATES AND A FLAG OF THE STATE OF NEW YORK, WHICH WERE FLYING OVER THE CAPITOL BUILDING AT THE TIME SUCH FLAGS WERE LOWERED TO HALF-STAFF IN COMPLIANCE WITH THE GOVERNOR'S ORDER. UPON THE PROCUREMENT OF SUCH FLAGS, THE COMMISSIONER, OR HIS OR HER REPRESENTATIVE, SHALL OFFER THE PRESENTMENT OF SUCH FLAGS, WITHOUT COST, TO THE PERSON DESIG- NATED TO DISPOSE OF THE REMAINS OF THE OFFICER, IN WHOSE HONOR SUCH FLAGS WERE LOWERED IN MEMORIAL.
