BILL NUMBER:S1850 TITLE OF BILL: An act to amend the parks, recreation and historic preservation law, in relation to authorizing persons under the age of fourteen to participate in special events involving snowmobiles PURPOSE: Section 1 This bill would amend the Parks, Recreation and Historic Preservation (PRHP) by allowing a person who is less than fourteen years of age to operate a snowmobile as a participant in a special event (as defined in Section 21.05 of PRHP Law) provided that: the special event is held in accordance with any relevant statutes, rules and regulations; the PRHP Commissioner authorized the event; he/she obtains written consent of his or her parent or legal guardian; and the PREP Commissioner adopts rules and regulations relating to such participants. The PRHP Commissioner must review and consider those rules and regulations published by internal organizations that promote such events, including but not limited to, the International Series of Champions and the International Snowmobile Racing Association. LITTLE, DeFRANCISCO, LARKIN, RANZENHOFER, RITCHIE, SAVINO, SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law, in relation to authorizing persons under the age of fourteen to partic- ipate in special events involving snowmobiles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 25.19 of the parks, recreation and historic preservation law is amended by adding a new paragraph (d) to read as follows: (D) A PERSON LESS THAN FOURTEEN YEARS OF AGE MAY OPERATE A SNOWMOBILE AS A PARTICIPANT IN A SPECIAL EVENT, DEFINED BY SUBDIVISION SIXTEEN OF SECTION 21.05 OF THIS TITLE, PROVIDED THAT: (1) THE SPECIAL EVENT IS HELD IN ACCORDANCE WITH ANY RELEVANT STAT- UTES, RULES, OR REGULATIONS; (2) THE SPECIAL EVENT IS AUTHORIZED BY THE COMMISSIONER, AS PROVIDED FOR IN SECTION 25.11 OF THIS ARTICLE; (3) SUCH PERSON OBTAINS THE WRITTEN CONSENT OF HIS OR HER PARENT OR LEGAL GUARDIAN; AND (4) THE COMMISSIONER SHALL ADOPT RULES AND REGULATIONS RELATING TO SUCH PARTICIPANTS AND IN DOING SO SHALL REVIEW AND CONSIDER FOR ADOPTION THOSE RULES AND REGULATIONS THAT HAVE BEEN PUBLISHED BY THE INTERNA- TIONAL ORGANIZATIONS THAT PROMOTE SUCH EVENTS, INCLUDING BUT NOT LIMITED TO, THE INTERNATIONAL SERIES OF CHAMPIONS AND THE INTERNATIONAL SNOWMO- BILE RACING ASSOCIATION. BILL NUMBER:S1850A TITLE OF BILL: An act to amend the parks, recreation and historic preservation law, in relation to authorizing persons under the age of fourteen to participate in special events involving snowmobiles PURPOSE: This act would make it explicit that the commissioner's authority extends to the age of operation during competitive events and would allow the commissioner to impose reasonable conditions on the permit. SUMMARY OF PROVISIONS: Section 1 This bill would amend the Parks, Recreation and Historic Preservation (PRHP) Law by expanding the Commissioner's authority under section 21.11 regarding the issuing of special event permits. Section 2 contains the effective date. JUSTIFICATION: In 2013-14, 74 special event permits were issued by the Office. Many of these events involve participation in a competitive event by those less than 18 years of age. Subdivision 2 of section 25.11 of the parks, recreation and historic preservation law, as amended by chapter 839 of the laws of 1973, is amended and a new subdivision 3 is added to read as follows: 2. Snowmobiles operated at special events approved by the commissioner pursuant to subdivision one OF THIS SECTION shall be exempt from the provisions of this article concerning mufflers [and], lights AND AUTHOR- IZED AGE OF OPERATION, INCLUDING BY PERSONS LESS THAN FOURTEEN YEARS OF AGE, during the time of such operation, including all pre-race practice at the location of said meet and the provisions of article forty-seven of the vehicle and traffic law concerning registration. 3. THE COMMISSIONER MAY IMPOSE REASONABLE CONDITIONS TO ENSURE THAT ANY EVENT IS OPERATED CONSISTENT WITH THE GUIDELINES ESTABLISHED BY ANY NATIONAL OR INTERNATIONAL SANCTIONING ORGANIZATION. S 2.
