BILL NUMBER:S2842 TITLE OF BILL: An act to amend the civil service law, in relation to enacting the "state workforce injury reduction act" PURPOSE OF BILL: To ensure that agencies seriously examine injuries to their employees and formulate ways to prevent similar injuries from occurring in the future. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill names the act the "state workforce injury reduction act". Section 2 of the bill amends section 7 of the civil service law by adding a new subdivision 7 that requires each state agency referenced in the annual report issued by the president of the civil service commission pursuant to this section to write and submit an action plan with participation from employee representatives for reducing occurrences of such injuries in the coming year. Section 3 requires the act to take effect immediately.

ADDABBO, AVELLA -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to enacting the "state workforce injury reduction act" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as the "state workforce injury reduction act". S 2. Section 7 of the civil service law is amended by adding a new subdivision 7 to read as follows: 7. EACH STATE AGENCY REFERENCED IN THE ANNUAL REPORT ISSUED BY THE PRESIDENT PURSUANT TO SUBDIVISION SIX OF THIS SECTION SHALL WITHIN THIR- TY DAYS AFTER RECEIPT OF SUCH REPORT SUBMIT TO THE GOVERNOR, THE TEMPO- RARY PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY A WRITTEN ACTION PLAN FOR REDUCING OCCURRENCES OF SUCH INJURIES IN THE COMING YEAR. STATE AGENCIES WILL PROVIDE FOR EMPLOYEE PARTICIPATION THROUGH AN AUTHORIZED EMPLOYEE REPRESENTATIVE WHEN PREPARING AND IMPLEMENTING SUCH WRITTEN ACTION PLANS. S 3. UPON RECEIPT OF SUCH ACTION PLAN BUT NO LATER THAN ONE HUNDRED TWENTY DAYS AFTER ISSUING THE REPORT PURSUANT TO SUBDIVISION SIX OF THIS SECTION, THE PRESIDENT SHALL ISSUE AN ADDENDUM TO THE REPORT WITH A SUMMARY OF ALL OF THE ACTION PLANS SUBMITTED BY EACH AFFECTED STATE AGENCY TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY. IN ANY CASE WHERE ONE OR MULTIPLE COLLECTIVE BARGAINING UNITS ARE PRESENT WITHIN AN AFFECTED STATE AGENCY, THE STATE AGENCY SHALL INCLUDE THE COLLECTIVE BARGAINING REPRESENTATIVE IN ANY DISCUSSIONS ON REPORTS ISSUED PURSUANT TO THIS SUBDIVISION. NOTHING IN THIS SUBDIVISION SHALL BE CONSTRUED TO CONFLICT WITH A STATE AGENCY'S RESPONSIBILITY TO BARGAIN WITH THE COLLECTIVE BARGAINING REPRESENTATIVE PURSUANT TO ARTICLE FOURTEEN OF THIS CHAPTER.
