TITONE -- read once and referred to the Committee on Tourism, Parks, Arts and Sports Develop- ment AN ACT to amend the arts and cultural affairs law, in relation to estab- lishing the Edward Hopper citation of merit for visual artists THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The arts and cultural affairs law is amended by adding a new section 3.16 to read as follows: S 3.16. NEW YORK STATE EDWARD HOPPER CITATION OF MERIT FOR VISUAL ARTISTS. 1. THE GOVERNOR SHALL BIENNIALLY PRESENT THE NEW YORK STATE EDWARD HOPPER CITATION OF MERIT TO A DISTINGUISHED NEW YORK VISUAL ARTIST WHO IS MAKING A SIGNIFICANT CONTRIBUTION TO THE ADVANCEMENT OF THE ARTS IN NEW YORK STATE UPON THE RECOMMENDATION OF THE PANEL CONSTI- TUTED IN THIS SECTION. THE VISUAL ARTIST SELECTED SHALL BE CONSIDERED THE STATE VISUAL ARTIST AND THE CITATION SHALL CARRY AN HONORARIUM OF TEN THOUSAND DOLLARS. 2. THE COUNCIL ON THE ARTS SHALL BIENNIALLY APPOINT AND CONVENE AN ADVISORY PANEL OF DISTINGUISHED VISUAL ARTISTS AND PERSONS WITH PARTIC- ULAR EXPERTISE IN THE FIELD OF VISUAL ART. THE DIRECTOR OF THE COUNCIL AND THE ARTISTIC DIRECTOR OF THE EDWARD HOPPER HOUSE SHALL BE PERMANENT MEMBERS OF THE ADVISORY PANEL. EACH CURRENT STATE VISUAL ARTIST WILL SERVE AS A MEMBER OF THE PANEL IN CHOOSING THE NEXT NEW YORK STATE EDWARD HOPPER VISUAL ARTIST. UPON COMPLETION OF THE EXHIBITS, EACH GALLERY SHALL BE REIMBURSED FOR ADMINISTRATIVE FEES NOT TO EXCEED TWO THOUSAND FIVE HUNDRED DOLLARS. THE PANEL SHALL RECOMMEND TO THE GOVERNOR A VISUAL ARTIST WHOSE ACHIEVEMENTS MAKE HIM OR HER DESERVING OF SUCH RECOGNITION. 3. THE STATE VISUAL ARTIST SHALL PROMOTE AND ENCOURAGE THE VISUAL ARTS WITHIN THE STATE AND SHALL GIVE TWO PUBLIC SHOWINGS WITHIN THE STATE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
