BILL NUMBER: S8075 SPONSOR: HARCKHAM TITLE OF BILL: An act to amend the real property tax law, in relation to including certain spent nuclear fuel within the definition of real property PURPOSE OR GENERAL IDEA OF BILL: The purpose of this legislation is to include spent nuclear fuel, from a nuclear power station that has ceased operations, in the definition of real property. SUMMARY OF PROVISIONS: Section 1. Subdivision 12 of section 102 of the Real Property Tax Law is amended by adding a new paragraph (j) Spent nuclear fuel that is pending further or final disposal, including fuel stored in a spent fuel pool or in a dry cask storage system, from a nuclear power station following the permanent cessation of power operations of such station.

HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the real property tax law, in relation to including certain spent nuclear fuel within the definition of real property THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 12 of section 102 of the real property tax law is amended by adding a new paragraph (j) to read as follows: (J) SPENT FUEL POOLS AND DRY CASK STORAGE SYSTEMS IN WHICH NUCLEAR FUEL IS STORED AND IS PENDING FURTHER OR FINAL DISPOSAL FROM A NUCLEAR POWER STATION FOLLOWING THE PERMANENT CESSATION OF POWER OPERATIONS OF SUCH STATION. § 2. The real property tax law is amended by adding a new section 563 to read as follows: § 563. REAL PROPERTY USED TO STORE SPENT NUCLEAR FUEL. NOTWITHSTAND- ING ANY OTHER PROVISION OF LAW, REAL PROPERTY, AS DEFINED IN PARAGRAPH (J) OF SUBDIVISION TWELVE OF SECTION ONE HUNDRED TWO OF THIS CHAPTER, SHALL BE ASSESSABLE. § 3.
