 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   prohibiting  the  incineration  of  perfluoroalkyl and polyfluoroalkyl
   substances as a means of disposal
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  37-0101 of the environmental conservation law is
 amended by adding a new subdivision 7 to read as follows:
   7. "PERFLUOROALKYL AND POLYFLUOROALKYL  SUBSTANCES"  OR  "PFAS"  SHALL
 MEAN  SUBSTANCES  THAT  INCLUDE  ANY  MEMBER OF THE CLASS OF FLUORINATED
 ORGANIC CHEMICALS CONTAINING AT LEAST ONE FULLY FLOURISHED CARBON ATOM.
   § 2. The environmental conservation law is amended  by  adding  a  new
 section 37-0121 to read as follows:
 § 37-0121. PROHIBITION  AGAINST  THE  INCINERATION OF PERFLUOROALKYL AND
              POLYFLUOROALKYL SUBSTANCES.
   NO PERSON OR ENTITY SHALL INCINERATE, OR CAUSE TO BE INCINERATED,  ANY
 PERFLUOROALKYL AND POLYFLUOROALKYL SUBSTANCES.
   §  3.  This  act  shall take effect on the sixtieth day after it shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal of any rule or regulation necessary  for  the  implementation  of
 this  act  on its effective date are authorized to be made and completed
 on or before such effective date.
