NIOU, ENGLEBRIGHT -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to reme- dial program requirements THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (v) of paragraph (i) of subdivision 3 of section 27-1415 of the environmental conservation law, as amended by section 7 of part A of chapter 577 of the laws of 2004, is amended to read as follows: (v) Proximity to real property currently used for residential use, and to urban, commercial, industrial, agricultural, SCHOOL OR DAY CARE FACILITIES and recreational areas. § 2. This act shall take effect March 1, 2022 and apply to all appli- cations received on or after such date.
