 AN ACT to amend the public officers law, in relation to  prohibiting  an
   assistant  district  attorney from running for certain public offices,
   unless such individual first resigns from current employment

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 3-c of the public officers law is amended by adding
 a new subdivision 3 to read as follows:
   3. NO ASSISTANT DISTRICT ATTORNEY SHALL SEEK NOMINATION OR ELECTION TO
 ANY  COMPENSATED  FEDERAL,  STATE OR LOCAL PUBLIC OFFICE, OTHER THAN THE
 OFFICE OF DISTRICT ATTORNEY OR A POSITION AS A JUDICIAL OFFICER  WHO  IS
 AUTHORIZED  TO  PRESIDE OVER A COURT OF RECORD, OR SHALL BECOME A CANDI-
 DATE FOR SUCH OFFICE, UNLESS SUCH INDIVIDUAL FIRST RESIGNS FROM  HIS  OR
 HER  PUBLIC  EMPLOYMENT,  OR REQUESTS AND IS GRANTED BY THEIR APPOINTING
 AUTHORITY A LEAVE OF ABSENCE WITHOUT PAY. SUCH RESIGNATION OR LEAVE MUST
 COMMENCE BEFORE SUCH INDIVIDUAL  ENGAGES  IN  ANY  CAMPAIGN  ACTIVITIES,
 INCLUDING  BUT  NOT  LIMITED  TO,  ANNOUNCING  A  CANDIDACY, CIRCULATING
 PETITIONS, SOLICITING CONTRIBUTIONS, DISTRIBUTING LITERATURE, OR  TAKING
 ANY OTHER ACTION TO ACTIVELY PROMOTE ONESELF AS A CANDIDATE FOR ELECTIVE
 OFFICE.
   § 2. This act shall take effect thirty days after it shall have become
 a law.
