   tee on Corporations, Authorities and Commissions
 
 AN ACT to amend the public service law, in relation to requiring  utili-
   ties to repair certain roadways
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 5 of the public service law is amended by adding  a
 new subdivision 7 to read as follows:
   7.  THE COMMISSION SHALL REQUIRE ANY UTILITY SUBJECT TO THE PROVISIONS
 OF THIS CHAPTER TO REPAIR AND RESTORE  TO  ITS  ORIGINAL  CONDITION  ANY
 STATE  OR  LOCAL  HIGHWAY  LOCATED  IN  A  CITY, COUNTY, TOWN OR VILLAGE
 OUTSIDE OF A CITY WITH A POPULATION OF ONE  MILLION  OR  MORE,  THAT  IT
 DISTURBS OR DESTROYS WHILE MAINTAINING ITS RESPECTIVE SERVICE.
   § 2. This act shall take effect on the one hundred twentieth day after
 it  shall have become a law. Effective immediately, the addition, amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation of this act on its effective date are authorized to be  made  and
 completed on or before such effective date.
