 AN  ACT to amend the agriculture and markets law, in relation to requir-
   ing the department of agriculture and markets to promote participation
   in Nourish New York program for black, indigenous and people of  color
   site controlled farms

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 452 of the agriculture and markets law  is  amended
 by adding a new subdivision 3-a to read as follows:
   3-A.  THE COMMISSIONER SHALL PROVIDE MEANS, WHICH SHALL INCLUDE FINAN-
 CIAL AND TECHNICAL SUPPORT, INCLUDING BUT NOT LIMITED TO  INFRASTRUCTURE
 DEVELOPMENT,  PRIORITY  GRANTS  RELATED  TO PROCESSING AND REFRIGERATION
 SYSTEMS, PERMIT ASSISTANCE, CREATION OF A LIAISON TO  NOURISH  NEW  YORK
 PROGRAM,  AND  INPUT  TO BEST PRACTICES FOR NOURISH NEW YORK PROGRAM, TO
 ENSURE AN EFFECTIVE CONNECTION TO MARKETS AND PARTICIPATION IN THE NOUR-
 ISH NEW YORK PROGRAM BY BLACK,  INDIGENOUS  AND  PEOPLE  OF  COLOR  SITE
 CONTROLLED  FARMS.  THE  DEPARTMENT  SHALL  INCLUDE  AND  PRIORITIZE THE
 PROCUREMENT OF AGRICULTURAL PRODUCTS FROM BLACK, INDIGENOUS  AND  PEOPLE
 OF  COLOR  SITE  CONTROLLED FARMS AS A CORE COMPONENT OF THE NOURISH NEW
 YORK PROGRAM FOOD DISTRIBUTION SYSTEM AND SHALL ESTABLISH A PRICE  POINT
 FOR  AGRICULTURAL  PRODUCTS  FROM  BLACK, INDIGENOUS AND PEOPLE OF COLOR
 OWNED FARMS THAT IS, AT A MINIMUM,  SUFFICIENT  TO  COVER  THE  COST  OF
 PRODUCTION,  TEMPORARY  STORAGE AND TRANSPORTATION TO FOOD RELIEF ORGAN-
 IZATIONS.
   § 2. This act shall take effect immediately.
