S T A T E O F N E W Y O R K ________________________________________________________________________ 9486 I N A S S E M B L Y March 7, 2022 ___________ Introduced by M. of A. FRONTUS -- read once and referred to the Commit- tee on Education AN ACT to amend the education law, in relation to requiring school districts in the state to complete an analysis to determine learning loss and delayed educational progress for students who participated in an individualized learning plan and did not receive in-person learning due to the COVID-19 state disaster emergency THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 4402-a to read as follows: § 4402-A. COVID-19 COMPENSATORY SERVICES FOR INDIVIDUALIZED EDUCATION PROGRAMS. THE BOARD OF EDUCATION OR TRUSTEES OF EACH SCHOOL DISTRICT AND THE CITY SCHOOL DISTRICT OF THE CITY OF NEW YORK SHALL COMPLETE AN ANAL- YSIS FOR COVID-19 COMPENSATORY SERVICES FOR EVERY STUDENT WHO WAS TAKING PART IN AN INDIVIDUALIZED EDUCATION PROGRAM (IEP) ON MARCH SIXTEENTH, TWO THOUSAND TWENTY. SUCH ANALYSIS SHALL DETERMINE THE VALUE OF ANY LOSS OF LEARNING AND DELAYED EDUCATIONAL PROGRESS FOR EACH STUDENT DUE TO IEP SERVICES THAT WERE NOT PROVIDED IN PERSON DUE TO THE COVID-19 STATE DISASTER EMERGENCY. SUCH ANALYSIS SHALL BE COMPLETED WITHIN ONE YEAR OF THE EFFECTIVE DATE OF THIS SECTION AND SHALL BE SUBMITTED TO THE COMMIS- SIONER UPON COMPLETION. § 2. This act shall take effect immediately and shall expire and be deemed repealed upon the submission of the analysis required pursuant to section one of this act; provided that the commissioner of education shall notify the legislative bill drafting commission upon the occur- rence of the submission of such analysis in order that the commission may maintain an accurate and timely effective data base of the official text of the laws of the state of New York in furtherance of effectuating the provisions of section 44 of the legislative law and section 70-b of the public officers law.
