TITLE OF BILL:

An act to amend the public housing law, in relation to requiring enti-
ties responsible for the provision of vital services to coordinate and
work expeditiously to restore service whenever such service is inter-
rupted

 
PURPOSE:

The purpose of this legislation is to include gas alongside other vital
services about which the New York City Housing Authority ("NYCHA") must
publish public information regarding reported disruptions, the length of
such disruption and the steps taken to restore services. The bill
further requires the department of housing preservation and development,
any other New York City or State agency with jurisdiction over the
conditions, and utility corporations in ownership of the infrastructure
required to provide such services, to remedy any such interruptions as
expeditiously as possible. The bill further provides that such utility
corporations that cannot demonstrate a good faith effort to comply with

this legislation be subject to a daily financial penalty for each occu-
pied unit affected by the interruption.

 
SUMMARY OF PROVISIONS:

Section 1 amends subdivision 1 of section 402-e of the public housing
law, 2 as amended by chapter 47 of the laws of 2020, by adding gas to
the list of vital services on which NYCHA is required to publish regular
updates, and adds a new subdivision 5 that requires all government and
utility entities responsible for the provision of essential services
coordinate and work expeditiously to restore service whenever it is
required to be interrupted, and authorizes financial penalties for util-
ity companies who cannot demonstrate good-faith efforts to restore
service.

Section 2 provides for the effective date.

 
JUSTIFICATION:

As of August 2021, 56 NYCHA developments across New York City are expe-
riencing gas outages, some of which have lasted for several months or
longer. Like electricity, heat, water and working elevators, gas is a
vital service that enables residents to prepare their own food safely
and- especially during a pandemic- minimize unnecessary contact with
takeout and delivery food options. Because restoration of this essential
service can often take months, affected residents, not only incur addi-
tional food costs, they are forced to work with inadequate replacement
equipment like hotplates for an inordinate amount of time. This legis-
lation aims to protect NYCHA residents from these hardships by creating
an incentive for public authorities, city and state agencies, and utili-
ty companies to work together quickly and efficiently to restore vital
gas service to residents experiencing an outage.

 AN ACT to amend the public housing law, in relation to  requiring  enti-
   ties responsible for the provision of vital services to coordinate and
   work  expeditiously to restore service whenever such service is inter-
   rupted

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision 1 of section 402-e of the public housing law,
 as amended by chapter 47 of the laws of  2020,  is  amended  and  a  new
 subdivision 5 is added to read as follows:
   1.  In order to ensure compliance and enforcement of the New York city
 housing authority's duty to provide heat, water,  electricity,  GAS  and
 elevator  service,  the  New  York  city housing authority shall publish
 information regarding reported disruptions in such services, the  length
 of such disruptions and the steps taken to restore services. Starting on
 May  first,  two  thousand  twenty,  the New York city housing authority
 shall publish such information on its website. For six months after  the
 original  publication  date,  the  New York city housing authority shall
 retain such information on its website.
   5. A. THE DEPARTMENT OF HOUSING PRESERVATION AND DEVELOPMENT,  OR  ANY
 AGENCY  OF  THE  CITY  OF  NEW  YORK  OR  STATE  AGENCY CHARGED WITH THE
 INSPECTION OF CONDITIONS, REQUIRED TO REMEDY CONDITIONS, OR WITH GENERAL
 JURISDICTION TO REMEDY CONDITIONS, AND ANY UTILITY CORPORATION IN OWNER-
 SHIP OR CONTROL OF THE METERS, PIPES, FITTINGS, WIRES AND OTHER  APPARA-
 TUS  ASSOCIATED  WITH THE ESTABLISHMENT OF SERVICE TO A RESIDENCE, SHALL
 ENSURE THAT ALL INTERRUPTIONS OF VITAL SERVICES SET FORTH IN SUBDIVISION
 ONE OF THIS SECTION BE REMEDIED AS EXPEDITIOUSLY AS PRACTICABLE.
   B. FOR PURPOSES OF THIS SUBDIVISION,  "EXPEDITIOUSLY  AS  PRACTICABLE"
 SHALL MEAN A REQUIREMENT THAT EACH RESPONSIBLE ENTITY DESCRIBED IN PARA-

 SERVICE, INCLUDING, BUT NOT LIMITED TO:
   (I) APPLYING FOR EMERGENCY REPAIR PERMITS;
   (II)  COORDINATING  WITH  ALL  RELEVANT AGENCIES AND CORPORATIONS ON A
 PLAN OF RESTORATION;
   (III) COMMUNICATING SAID RESTORATION PLAN TO ALL  AFFECTED  RESIDENTS;
 AND
   (IV)  MITIGATING  THE EFFECTS OF SERVICE INTERRUPTION THROUGH MONETARY
 COMPENSATION OR REBATE.
   C. ANY UTILITY CORPORATION IN OWNERSHIP  OR  CONTROL  OF  THE  METERS,
 PIPES,  FITTINGS,  WIRES  AND OTHER APPARATUS ASSOCIATED WITH THE ESTAB-
 LISHMENT OF SERVICE TO A RESIDENCE WHO CANNOT DEMONSTRATE A  GOOD  FAITH
 EFFORT TO COMPLY WITH THE PROVISIONS OF THIS SUBDIVISION SHALL BE LIABLE
 FOR  A  PENALTY  OF TWO HUNDRED FIFTY DOLLARS FOR EACH AFFECTED OCCUPIED
 UNIT FOR EACH DAY DURING WHICH SERVICE REMAINS INTERRUPTED.
   § 2. This act shall take effect immediately.
