Requires the department of health to post on its website certain data relating to the total number of personnel employed or affiliated with certain health care facilities, personnel who are no longer employed by such facilities, and the reason for such personnel leaving such employment, the number of requested personnel from the New York state surge and flex operations center, and the number of personnel employed as a result of such center.

   printed to be committed to the Committee on Rules
 
 AN ACT to amend the public health law,  in  relation  to  requiring  the
   department  of  health to post on its website certain data relating to
   personnel employed or affiliated with health care facilities

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  public health law is amended by adding a new section
 206-c to read as follows:
   § 206-C. SPECIAL REQUIREMENTS WITH RESPECT TO HOSPITAL,  NURSING  HOME
 AND OTHER HEALTHCARE FACILITY STAFFING DATA. 1. FOR THE PURPOSES OF THIS
 SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS:
   (A) "COVERED ENTITY" MEANS:
   (I)  A  "HOSPITAL"  AS  DEFINED IN SECTION TWENTY-EIGHT HUNDRED ONE OF
 THIS CHAPTER;
   (II) ANY AGENCY ESTABLISHED PURSUANT TO  ARTICLE  THIRTY-SIX  OF  THIS
 CHAPTER;
   (III)  A  "HOSPICE"  AS  DEFINED  IN SECTION FOUR THOUSAND TWO OF THIS
 CHAPTER; AND
   (IV) AN ADULT CARE FACILITY UNDER THE DEPARTMENT'S REGULATORY AUTHORI-
 TY, PURSUANT TO ARTICLE SEVEN OF THE SOCIAL SERVICES LAW.
   (B) "PERSONNEL" MEANS PERSONS EMPLOYED BY OR AFFILIATED WITH A COVERED
 ENTITY, WHETHER PAID OR UNPAID, INCLUDING BUT NOT LIMITED TO  EMPLOYEES,
 MEMBERS  OF  THE MEDICAL AND NURSING STAFF, CONTRACT STAFF, STUDENTS AND
 VOLUNTEERS, WHO ENGAGE IN ACTIVITIES, THAT IF SUCH PERSON  WAS  INFECTED
 WITH  COVID-19, HE OR SHE COULD POTENTIALLY EXPOSE OTHER COVERED PERSON-
 NEL, PATIENTS OR RESIDENTS TO SUCH DISEASE.
   (C) "NEW YORK STATE SURGE AND FLEX OPERATIONS CENTER" MEANS THE  STATE
 OPERATED CENTER LED BY THE DEPARTMENT TO MONITOR STAFFING OPERATIONS AND
 TRENDS  STATEWIDE,  PROVIDE  GUIDANCE  TO  HEALTHCARE FACILITIES AND AID
 FACILITIES WITH STAFFING SHORTAGES.
