BILL NUMBER: S7479 SPONSOR: REICHLIN-MELNICK TITLE OF BILL: An act to amend the real property actions and proceedings law, in relation to requiring loan services for loans on vacant and abandoned residential real property to pay certain condominium common charges PURPOSE: This bill would clarify that loan servicers must pay the common charges for vacant and abandoned condominiums. SUMMARY OF PROVISIONS: Section one of the bill amends section 1308 of the real property actions and proceedings law as it relates to including common charges for vacant and abandoned condominiums to the list of required obligations by loan servicers. Section two of the bill relates to the effective date.

REICHLIN-MELNICK -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the real property actions and proceedings law, in relation to requiring loan services for loans on vacant and abandoned residential real property to pay certain condominium common charges THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (k) of subdivision 4 of section 1308 of the real property actions and proceedings law, as amended by chapter 168 of the laws of 2019, is amended to read as follows: (k) pay homeowners' association, CONDOMINIUM COMMON CHARGES AS DEFINED IN SECTION THREE HUNDRED THIRTY-NINE-E OF THE REAL PROPERTY LAW or coop- erative fees as needed to maintain the property. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD05938-01-1
