TITLE OF BILL:

An act to amend part U of chapter 57 of the laws of 2005 amending the
labor law and other laws relating to implementing the state fiscal plan
for the 2005-2006 state fiscal year, in relation to the New York state
higher education capital matching grant board

 
SUMMARY OF SPECIFIC PROVISONS:

Section 1 adds a new paragraph b-1 to subdivision 3 to authorize and
direct the board, within amounts appropriated therefor, to award match-
ing capital grants of up to two million dollars, with one million each
for the public and private college sectors.

Section 2 adds a new paragraph h-1 to subdivision 4 to establish the
timelines for applications and to provide the process for unutilized
grants.

Section 3 is the effective date.

 
JUSTIFICATION:

The education sector is the most targeted industry for cyber attacks,
hit by more than 60% of all malware encounters in the professional
world. This is seven times higher than the next closest industry. The
threat to colleges and universities has only increased during the
pandemic, with some schools paying out up to one million dollars to
hackers who gained access to sensitive data within their systems. As a
result, the FBI early in 2021 issued an advisory notice to educational
institutions regarding certain malicious software that is being used to
target their infrastructure. And as recently as December of 2021, a
massive ransomware attack on the HR management company Kronos disabled
paycheck services across the country during the holiday season. Despite
the ever-present threat, the level of upgrades and monitoring needed to
combat these constant attacks comes with a significant price tag.

This bill, by authorizing grants of up to 2 million dollars to both
public and private colleges for projects to implement, modify, or
enhance their IT infrastructure, will provide much-needed financial
relief to these institutions. Such funds will be supplementing current
HECAP grants, not replacing them. By putting these systems in place now,
these schools will be better equipped to fight the digital threat facing
their industry. This will lead to both the greater protection of vital
information and decreased cost to these colleges and the state.

 AN ACT to amend part U of chapter 57 of the laws of  2005  amending  the
   labor  law  and  other  laws relating to implementing the state fiscal
   plan for the 2005-2006 state fiscal year, in relation to the New  York
   state higher education capital matching grant board
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 3 of part U of chapter 57 of the laws  of  2005
 amending the labor law and other laws relating to implementing the state
 fiscal plan for the 2005-2006 state fiscal year, as amended by section 1
 of  part D of chapter 63 of the laws of 2005, is amended by adding a new
 paragraph (b-1) to read as follows:
   (B-1) WITHIN  AMOUNTS  APPROPRIATED  THEREFOR,  THE  BOARD  IS  HEREBY
 AUTHORIZED  AND  DIRECTED  TO AWARD MATCHING CAPITAL GRANTS TOTALING TWO
 MILLION DOLLARS FOR PROJECTS TO IMPLEMENT, MODIFY, OR OTHERWISE  ENHANCE
 CYBER SECURITY INFRASTRUCTURE. THE PUBLIC COLLEGE SECTOR AND THE COLLEGE
 SECTOR  SHALL  EACH BE ELIGIBLE TO RECEIVE GRANTS TOTALING NOT MORE THAN
 ONE MILLION DOLLARS. EACH PUBLIC COLLEGE AND COLLEGE SHALL  BE  ELIGIBLE
 FOR  A  GRANT  AWARD  AMOUNT  AS  DETERMINED BY CALCULATIONS PURSUANT TO
 SUBDIVISION FIVE OF THIS SECTION. IN ADDITION, SUCH PUBLIC COLLEGES  AND
 COLLEGES  SHALL  BE ELIGIBLE TO COMPETE FOR ADDITIONAL FUNDS PURSUANT TO
 PARAGRAPH (H-1) OF SUBDIVISION FOUR OF THIS SECTION.
   § 2. Subdivision 4 of part U of chapter 57 of the laws of 2005  amend-
 ing  the  labor  law  and  other laws relating to implementing the state
 fiscal plan for the 2005-2006 state fiscal year, as amended by section 1
 of part D of chapter 63 of the laws of 2005, is amended by adding a  new
 paragraph (h-1) to read as follows:
   (H-1)  IF  A  PUBLIC  COLLEGE OR COLLEGE DOES NOT APPLY FOR A GRANT BY
 MARCH THIRTY-FIRST, TWO THOUSAND TWENTY-FIVE, FUNDS ASSOCIATED WITH SUCH
 POTENTIAL GRANT SHALL BE AWARDED,  ON  A  COMPETITIVE  BASIS,  TO  OTHER
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

 PUBLIC  COLLEGES OR COLLEGES. PUBLIC COLLEGES SHALL BE ELIGIBLE TO APPLY
 FOR UNUTILIZED PUBLIC COLLEGE GRANTS WITHIN THEIR RESPECTIVE SYSTEMS AND
 COLLEGES SHALL BE ELIGIBLE TO APPLY FOR UNUTILIZED COLLEGE  GRANTS.  THE
 DORMITORY  AUTHORITY  SHALL DEVELOP A REQUEST FOR PROPOSALS AND APPLICA-
 TION PROCESS, IN CONSULTATION WITH THE BOARD, FOR SUCH GRANTS AND  SHALL
 DEVELOP  CRITERIA,  SUBJECT  TO REVIEW BY THE BOARD, FOR THE AWARDING OF
 SUCH GRANTS. SUCH  CRITERIA  SHALL  INCORPORATE  THE  MATCHING  CRITERIA
 CONTAINED  IN  PARAGRAPH  (C)  OF  THIS SUBDIVISION, AND THE APPLICATION
 CRITERIA SET FORTH IN PARAGRAPH (E) OF THIS SUBDIVISION.  THE  DORMITORY
 AUTHORITY  SHALL REQUIRE ALL APPLICATIONS IN RESPONSE TO THE REQUEST FOR
 PROPOSALS TO BE SUBMITTED BY SEPTEMBER FIRST, TWO THOUSAND  TWENTY-FIVE,
 AND  THE BOARD SHALL ACT ON EACH APPLICATION FOR SUCH MATCHING GRANTS BY
 NOVEMBER FIRST, TWO THOUSAND TWENTY-FIVE.
   § 3. This act shall take effect immediately.
