BILL NUMBER: S7798 SPONSOR: HINCHEY TITLE OF BILL: An act to amend the public health law, in relation to alcohol and opioid overdose data, and to amend chapter 66 of the laws of 2016, amending the public health law relating to reporting of opioid overdose data, in relation to the effectiveness thereof PURPOSE: This is a chapter amendment that makes changes to provisions of L.2021, c.741, relating to the process of reporting alcohol abuse. SUMMARY OF PROVISIONS: As passed, the underlying chapter expanded requirements of an annual DOH report on statewide opioid overdoses to include demographic and emergen- cy room utilization data on alcohol overdoses.The Chapter amendment strikes parts of the original bill to keep opioid reporting practices status quo and instead creates a distinct reporting requirement on

HINCHEY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to alcohol and opioid overdose data, and to amend chapter 66 of the laws of 2016, amending the public health law relating to reporting of opioid overdose data, in relation to the effectiveness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5 of section 3309 of the public health law, as added by a chapter of the laws of 2021 amending the public health law relating to reporting of alcohol overdose data and amending chapter 66 of the laws of 2016 amending the public health law relating to reporting of opioid overdose data, as proposed in legislative bills numbers S. 6571 and A. 6166-A, is amended to read as follows: 5. The commissioner shall publish findings on statewide opioid [and alcohol] overdose data that reviews overdose death rates and other information to ascertain changes in the cause and rates of opioid [and alcohol] overdoses, including fatal opioid [and alcohol] overdoses. The report shall be submitted annually, on or before October first, to the governor, the temporary president of the senate, the speaker of the assembly and the chairs of the senate and assembly health committees, and shall be made public on the department's internet website. The report shall include, at a minimum, the following information on a coun- ty basis: (a) information on opioid [and alcohol] overdoses and opioid [and alcohol] overdose deaths, including age, gender, ethnicity, and geographic location; (b) data on emergency room utilization for the treatment of opioid [and alcohol] overdose; (c) data on utilization of pre-hospital services; (d) data on the dispensing and utilization of opioid antagonists; and (e) any other information necessary to ascertain the success of the program, areas of the state which are experiencing particularly high rates of overdoses, ways to determine if services, resources and EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
