TITLE OF BILL:

An act to amend the education law, in relation to requiring narcan,
naloxone or other approved medication to be included in overdose rescue
kits on college and university campuses

 
PURPOSE:

Requires narcan, naloxone or other approved medication to be included in
overdose rescue kits on college and university campuses

 
SUMMARY OF PROVISIONS:

Section 1 amends the education law to require the commissioner in
collaboration with the commissioner of health, ensure that all college
and university campuses in the state include an affixed wall mount
containing narcan, naloxone or other medications approved by the depart-
ment of health and the federal food and drug administration that when
administered, negates or neutralizes, in whole or in part, the pharmaco-

logical effects of an opioid on the human body. Such wall mount must be
visually free of advertisements and located readily accessible for
public use and shall be registered with campus security.

Section 2 is the effective date.

 
JUSTIFICATION:

Every second counts when an individual is experiencing a life-threaten-
ing opioid overdose. This bill seeks to require that all college and
university campuses are equipped with an affixed wall mount containing
narcan, naloxone or other medication approved to negate or neutralize
the pharmacological effects of an opioid in the human body. Equipping
campuses with an affixed wall mount allows for a quick and timely
retrieve to the person suffering from an overdose.

 AN ACT to amend the education law,  in  relation  to  requiring  narcan,
   naloxone  or  other  approved  medication  to  be included in overdose
   rescue kits on college and university campuses
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 305 of the education law is amended by adding a new
 subdivision 60 to read as follows:
   60.  THE  COMMISSIONER  SHALL CONSULT AND COLLABORATE WITH THE COMMIS-
 SIONER OF HEALTH TO ENSURE THAT ALL COLLEGE AND UNIVERSITY  CAMPUSES  IN
 THE  STATE  INCLUDE  AN  AFFIXED  WALL MOUNT THAT IS CLEARLY VISIBLE AND
 LABELED WITH THE WORDS:  "OVERDOSE RESCUE KIT - NARCAN NASAL SPRAY",  OR
 OTHER  LANGUAGE SPECIFICALLY APPROVED BY THE COMMISSIONER. SUCH OVERDOSE
 RESCUE KITS SHALL BE VISUALLY FREE OF ADVERTISEMENTS AND  LOCATED  WHERE
 READILY  ACCESSIBLE  FOR  PUBLIC  USE. THE LOCATIONS OF SUCH RESCUE KITS
 SHALL BE REGISTERED WITH CAMPUS SECURITY. SUCH RESCUE KIT SHALL  INCLUDE
 NARCAN,  NALOXONE  OR  OTHER  MEDICATION  APPROVED BY THE NEW YORK STATE
 DEPARTMENT OF HEALTH AND THE FEDERAL FOOD AND DRUG ADMINISTRATION  THAT,
 WHEN  ADMINISTERED,  NEGATES  OR  NEUTRALIZES,  IN WHOLE OR IN PART, THE
 PHARMACOLOGICAL EFFECTS OF AN OPIOID IN THE HUMAN BODY.
   § 2. This act shall take effect immediately.
