BILL NUMBER: S8205 SPONSOR: HINCHEY TITLE OF BILL: An act to amend the public health law, in relation to establishing a statewide advanced care planning campaign to promote public awareness of hospice and palliative care services PURPOSE OR GENERAL IDEA OF BILL: The purpose of this legislation is to create a public education campaign to inform the public about the importance of advance care planning and to raise awareness of hospice and palliative care services. SUMMARY OF PROVISIONS: Section 1 amends section 4010 of the public health law and requires that the commissioner establish a statewide advanced care planning campaign. The campaign will promote public awareness of hospice and palliative care services, inform the public of the importance of advanced care planning, and educate individuals on the tools available to ensure their

HINCHEY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to establishing a statewide advanced care planning campaign to promote public awareness of hospice and palliative care services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 4010 of the public health law is amended by adding a new subdivision 5 to read as follows: 5. THE COMMISSIONER SHALL ESTABLISH A STATEWIDE ADVANCED CARE PLANNING CAMPAIGN TO: (A) PROMOTE PUBLIC AWARENESS OF HOSPICE AND PALLIATIVE CARE SERVICES; (B) INFORM THE PUBLIC OF THE IMPORTANCE OF ADVANCE CARE PLANNING AND THE INDIVIDUAL'S RIGHT TO DIRECT AND PARTICIPATE IN HEALTH CARE DECI- SIONS AFFECTING THE INDIVIDUAL; AND (C) EDUCATE INDIVIDUALS ON THE TOOLS AVAILABLE TO ENSURE THEIR HEALTH CARE DECISIONS ARE HONORED. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date. HINCHEY, GALLIVAN, OBERACKER, THOMAS -- read twice and ordered printed, and when printed to be committed to the Committee on Health -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public health law, in relation to establishing a statewide advance care planning campaign to promote public awareness of hospice and palliative care services; and to repeal certain provisions of such law related thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (e) of subdivision 1 of section 207 of the public health law, as amended by section 16 of part A of chapter 109 of the laws of 2010, is amended to read as follows: (e) The COMMISSIONER SHALL ESTABLISH A STATEWIDE ADVANCE CARE PLAN- NING CAMPAIGN TO: (I) PROMOTE PUBLIC AWARENESS OF HOSPICE AND PALLIATIVE CARE SERVICES; AND PALLIATIVE CARE OPTIONS FOR PATIENTS WITH A TERMINAL ILLNESS OR CONDITION; (II) INFORM THE PUBLIC OF THE IMPORTANCE OF ADVANCE CARE PLANNING AND THE INDIVIDUAL'S RIGHT TO DIRECT AND PARTICIPATE IN HEALTH CARE DECI- SIONS AFFECTING THE INDIVIDUAL; (III) EDUCATE INDIVIDUALS ON THE TOOLS AVAILABLE TO ENSURE THEIR HEALTH CARE DECISIONS ARE HONORED; AND (IV) THE need and importance for consumers and patients to have an advance directive, particularly a health care proxy, and the need and importance for health care providers to play a leadership role in discussing end-of-life care preferences and values with patients and to provide patients with health care proxy forms. § 2. Paragraph (h) of subdivision 1 of section 207 of the public health law is REPEALED. § 3. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
