TITLE OF BILL:

An act to amend the vehicle and traffic law, in relation to the creation
of an electric vehicle clean energy website

 
PURPOSE:

To increase consumer access to cost benefits and financial incentives
related to choosing an all-electric vehicle in New York state and there-
by advance the implementation of the state's clean energy targets

 
SUMMARY OF SPECIFIC PROVISIONS:

A new section 114-f is added to the vehicle and traffic law to establish
the definition and characteristics of an electric vehicle.

A new section 224-b is added to the vehicle and traffic law to establish
the creation of an electric vehicle clean energy website by the commis-
sioner, in consultation with NYSERDA, to provide information about elec-

tric vehicles such as: vehicle's carbon footprint; a searchable cost and
mileage calculator by vehicle make, model and year; a list of electric
vehicle fueling stations in the state; information on tax credits,
rebates, and related incentives; and options for installing charging
equipment at home.

The link would be provide on all communications from the department to
registered vehicle owners, in materials created for the pre-licensing
examination for new drivers, and on removable stickers at all dealer-
ships in the state.

 
JUSTIFICATION:

Recognizing that the transportation sector accounts for approximately
20% of greenhouse gas emissions, increasing the number of zero emission
vehicles on the road will play an important role in helping the state
reach its aggressive clean energy targets. In 2021 New York enacted a
new law, Chapter 243 of the Laws of 2021, requiring that one hundred
percent of in-state sales of new passenger cars and trucks must be zero-
emission by 2035; this means in a little over ten years, new fully gas-
engine vehicles will no longer be sold in New York. Therefore, the next
step in the transition should be supporting the consumer as they consid-
er the purchase of their first hybrid or electric vehicle. The clean
energy website created by this bill will provide the tools needed and
will include a cost and mileage calculator, information on tax credit,
rebates and other financial incentives, and will be easily accessible
from the DMV website and on vehicles at all dealerships in New York
state. By including the website on all communications from DMV, as well
as on the cars themselves in all dealers' lots, consumers will have easy
access to the information needed when purchasing a zero emission vehi-
cle.

 AN ACT to amend the vehicle and traffic law, in relation to the creation
   of an electric vehicle clean energy website
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  The  vehicle  and  traffic law is amended by adding a new
 section 114-f to read as follows:
   § 114-F. ELECTRIC VEHICLE. THE TERM "ELECTRIC VEHICLE" SHALL MEAN  AND
 INCLUDE A MOTOR VEHICLE THAT:
   1.  WAS  MANUFACTURED  FOR  USE PRIMARILY ON PUBLIC STREETS, ROADS AND
 HIGHWAYS;
   2. THE POWERTRAIN OF WHICH HAS NOT BEEN  MODIFIED  FROM  THE  ORIGINAL
 MANUFACTURER'S SPECIFICATIONS;
   3.  HAS  A  MAXIMUM  SPEED CAPABILITY OF AT LEAST FIFTY-FIVE MILES PER
 HOUR; AND
   4. IS PROPELLED AT LEAST IN PART BY AN ELECTRIC MOTOR  AND  ASSOCIATED
 POWER  ELECTRONICS WHICH PROVIDE ACCELERATION TORQUE TO THE DRIVE WHEELS
 SOMETIME DURING NORMAL VEHICLE OPERATIONS, AND  THAT  DRAWS  ELECTRICITY
 FROM A HYDROGEN FUEL CELL OR FROM A BATTERY THAT:
   (A) HAS A CAPACITY OF NOT LESS THAN FOUR KILOWATT HOURS; AND
   (B) IS CAPABLE OF BEING RECHARGED FROM AN EXTERNAL SOURCE OF ELECTRIC-
 ITY.
   §  2.  The  vehicle and traffic law is amended by adding a new section
 224-b to read as follows:
   § 224-B. ELECTRIC VEHICLE CLEAN ENERGY WEBSITE. 1.  THE  COMMISSIONER,
 IN  COOPERATION  WITH THE NEW YORK STATE ENERGY RESEARCH AND DEVELOPMENT
 AUTHORITY, SHALL COLLECT AND ANALYZE INFORMATION  ON  ELECTRIC  VEHICLES
 RELATING  TO  SUCH  ELECTRIC  VEHICLES'  CARBON FOOTPRINTS, ENERGY COSTS
 RELATED TO USE OF ELECTRIC VEHICLES,  AND  OTHER  INFORMATION  THAT  THE
 COMMISSIONER  SHALL  IDENTIFY  AS USEFUL FOR THE CREATION OF THE WEBSITE
 PURSUANT TO SUBDIVISION TWO OF THIS SECTION.
   2. THE COMMISSIONER, IN COOPERATION WITH THE  NEW  YORK  STATE  ENERGY
 RESEARCH AND DEVELOPMENT AUTHORITY, SHALL DEVELOP AND MAINTAIN A WEBSITE
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

 BASED  ON INFORMATION COLLECTED AND ANALYZED PURSUANT TO SUBDIVISION ONE
 OF THIS SECTION WHICH SHALL INCLUDE, AT A MINIMUM:
   (A)  A  CARBON  FOOTPRINT CALCULATOR THAT CAN BE USED TO CALCULATE THE
 CARBON FOOTPRINT OF ELECTRIC VEHICLES, SEARCHABLE BY SUCH ELECTRIC VEHI-
 CLES' MAKE, MODEL, AND YEAR, AND TO COMPARE SUCH CARBON FOOTPRINT TO THE
 CARBON FOOTPRINT OF SIMILAR NON-ELECTRIC MOTOR VEHICLES;
   (B) A COST-AND-MILEAGE CALCULATOR THAT CAN BE USED  TO  CALCULATE  THE
 COST-PER-MILE  OF  FUELING AN ELECTRIC VEHICLE, SEARCHABLE BY SUCH ELEC-
 TRIC VEHICLES' MAKE, MODEL, AND YEAR, AND TO COMPARE SUCH  COST-PER-MILE
 TO THE COST-PER-MILE OF FUELING SIMILAR NON-ELECTRIC MOTOR VEHICLES;
   (C)  A  LIST  OF LOCATIONS OF ALL ELECTRIC VEHICLE FUELING STATIONS IN
 THE STATE;
   (D) INFORMATION AND LINKS ON TAX CREDITS, REBATES, OR OTHER  FINANCIAL
 INCENTIVES AVAILABLE TO OWNERS OR PURCHASERS OF ELECTRIC VEHICLES;
   (E)  INFORMATION ON HOW TO INSTALL ELECTRIC VEHICLE CHARGING EQUIPMENT
 ON A RESIDENTIAL HOUSE OR OTHER RESIDENTIAL PROPERTY, INCLUDING INFORMA-
 TION ON INSTALLING A SEPARATE METER FOR ELECTRIC VEHICLE CHARGING EQUIP-
 MENT;
    (F) RATE OPTIONS FOR ELECTRIC VEHICLE OWNERS CHARGING  AT  HOME,  AND
 TIPS AND TOOLS FOR LOWERING ONE'S ENERGY BILL; AND
    (G)  ANY  OTHER  GENERAL INFORMATION THAT THE COMMISSIONER SHALL DEEM
 USEFUL FOR INDIVIDUALS CONSIDERING PURCHASING AN  ELECTRIC  VEHICLE  FOR
 THE FIRST TIME.
   3. THE COMMISSIONER SHALL CAUSE A LINK TO THE WEBSITE DEVELOPED PURSU-
 ANT TO SUBDIVISION TWO OF THIS SECTION TO BE:
   (A) POSTED ON THE DEPARTMENT'S WEBSITE;
   (B)  INCLUDED  IN  ANY  ELECTRONIC  OR MAIL COMMUNICATIONS SENT BY THE
 DEPARTMENT TO DRIVERS LICENSED PURSUANT TO TITLE FIVE OF  THIS  CHAPTER;
 AND
   (C)  INCLUDED  IN ANY PREPARATION MATERIALS CREATED AND DISTRIBUTED BY
 THE DEPARTMENT FOR THE PRE-LICENSING EXAMINATION UNDER SUBDIVISION  FOUR
 OF SECTION FIVE HUNDRED TWO OF THIS CHAPTER.
   4.  A DEALER, AS DEFINED IN SECTION FOUR HUNDRED FIFTEEN OF THIS CHAP-
 TER, SHALL ADHERE A REMOVEABLE STICKER CONTAINING A LINK TO THE  WEBSITE
 DEVELOPED  PURSUANT  TO  SUBDIVISION  TWO  OF  THIS SECTION TO THE FRONT
 WINDSHIELD OF ALL MOTOR VEHICLES OFFERED FOR SALE BY SUCH DEALER.
   5. THE DEPARTMENT AND THE NEW YORK STATE ENERGY RESEARCH AND  DEVELOP-
 MENT  AUTHORITY  MAY  CONSULT WITH ANY STATE OR LOCAL OFFICE, AGENCY, OR
 DEPARTMENT AND REQUEST INFORMATION FROM ANY SUCH ENTITY THAT IS RELEVANT
 AND MATERIAL TO THE COLLECTION AND ANALYZATION OF  INFORMATION  RELATING
 TO ELECTRIC VEHICLES AS REQUIRED UNDER SUBDIVISION ONE OF THIS SECTION.
   6. FOR THE PURPOSES OF THIS SECTION, THE TERM "CARBON FOOTPRINT" SHALL
 MEAN THE MEASURE OF A VEHICLE'S GREENHOUSE GAS EMISSIONS.
   § 3. This act shall take effect immediately.
