 Introduced  by  Sen. SKOUFIS -- read twice and ordered printed, and when
   printed to be committed to the Committee on  Energy  and  Telecommuni-
   cations
 
 AN  ACT to amend the public service law, in relation to imposing a mora-
   torium on increasing gas and electric prices, rates and charges
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The public service law is amended by adding a new section
 72-b to read as follows:
   § 72-B. MORATORIUM ON INCREASES IN GAS OR ELECTRICITY  PRICES.  1.  NO
 CORPORATION  OR PERSON SHALL SET ANY PRICES, RATES OR CHARGES FOR GAS OR
 ELECTRICITY WHICH ARE HIGHER THAN SUCH CORPORATION'S OR PERSON'S PRICES,
 RATES OR CHARGES FOR GAS OR ELECTRICITY ON THE EFFECTIVE  DATE  OF  THIS
 SECTION.
   2.  NO CORPORATION OR PERSON WHO RECEIVED AN APPROVED ELECTRIC AND GAS
 RATE PLAN FROM THE COMMISSION BETWEEN JANUARY FIRST, TWO THOUSAND  TWEN-
 TY-ONE  AND  THE EFFECTIVE DATE OF THIS SECTION SHALL FORMALLY REQUEST A
 RATE CASE FROM THE COMMISSION FOR A PERIOD OF FOUR YEARS FROM THE EFFEC-
 TIVE DATE OF THIS SECTION.
   3. NO CORPORATION OR PERSON WHO DID NOT RECEIVE AN  APPROVED  ELECTRIC
 AND  GAS  RATE PLAN FROM THE COMMISSION BETWEEN JANUARY FIRST, TWO THOU-
 SAND TWENTY-ONE AND THE EFFECTIVE DATE OF THIS  SECTION  SHALL  FORMALLY
 REQUEST  A  RATE CASE FROM THE COMMISSION FOR A PERIOD OF TWO YEARS FROM
 THE EFFECTIVE DATE OF THIS SECTION.
   § 2. This act shall take effect immediately.
