TITLE OF BILL:

An act to authorize the commissioner of the office of general services
to convey certain unappropriated state land to KIPP: Albany Community
Public Charter Schools; and providing for the repeal of such provisions
upon expiration thereof

 
PURPOSE OR GENERAL IDEA OF BILL::

Provides the authorization to the Commissioner of General Services to do
to transfer and convey the state-owned land located at 596 Manning
Boulevard, Albany, New Yolk to KIPP: Albany Community Public Charter
Schools.

 
SUMMARY OF PROVISIONS::

Section 1: Provides authorization for the Commissioner of OGS to trans-
fer and convey such lands to KIPP: Albany Community Public Charter
Schools, upon terms and conditions deemed proper.

Section 2: Provides general description of the state-owned land located
at 596 Manning Boulevard, Albany, New York that the Commissioner of OGS
is authorized to transfer and convey.

Section 3: Provides that the description of the land in section two of
this bill is not meant to be a legal description, and that, as a condi-
tion of any conveyance, KIPP: Albany Community Public Charter Schools
shall submit to the Commissioner of OGS a survey and description of the
property.

Section 4: Provides that the Commissioner of OGS shallt ransfer and
convey the property described in section two of this act only upon
application by KIPP: Albany Community Public Charter Schools, provides a
timeline for the application and conveyance.

Section 5: Provides for the approved uses of the land and that upon
termination of such use the land shall revert to the State of New York.

Section 6: Provides for an immediate effective date that shall expire
after three years of such date.

 
JUSTIFICATION::

The land located at 596 Manning Boulevard, Albany, New York, is vacant
property owned by the People of the State of New York, acting by and
through the Commissioner of Parks, Recreation and Historic Preservation
of the State of New York. The transfer of this property will alleviate
the need for maintenance and liability costs to the State and allow
KIPP: Albany Community Public Charter Schools to maintain the property,
improve traffic flow, and provide increased public access to the Tivoli
Lake Preserve in conjunction with the City of Albany.

 
FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENT::

To be determined.

 
EFFECTIVE DATE::

Immediately, and shall expire and be deemed repealed three years after
such date.

 AN ACT to authorize the commissioner of the office of  general  services
   to  convey certain unappropriated state land to KIPP: Albany Community
   Public  Charter  Schools;  and  providing  for  the  repeal  of   such
   provisions upon expiration thereof
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subject to the provisions of this act  but  notwithstanding
 any  other provision of law to the contrary, the commissioner of general
 services is hereby authorized to transfer and  convey  to  KIPP:  Albany
 Community  Public  Charter  Schools,  in consideration of one dollar and
 upon such other conditions as the  commissioner  may  deem  proper,  the
 state  land  located  at 596 Manning Boulevard, Albany, New York, in the
 county of Albany.
   § 2. The lands authorized by section one of this act to be transferred
 and conveyed are as follows:
   ALL that piece or parcel of land, situate, lying and being in the City
 of Albany, County of Albany, State of New York, more particularly bound-
 ed and described as follows:
   BEGINNING at a point in the north  line  of  Manning  Boulevard  North
 (a/k/a  Manning  Boulevard);  said  point  being  400  feet distant in a
 westerly direction from the intersection of the north  line  of  Manning
 Boulevard  North (a/k/a Manning Boulevard) and the west line of Northern
 Boulevard; thence northerly at right angles to the north line of Manning
 Boulevard North (a/k/a Manning Boulevard) a  distance  of  199.31  feet;
 thence westerly, parallel with the north line of Manning Boulevard North
 (a/k/a Manning Boulevard) and along the north line of the lands conveyed
 to Louis J. Valente by New York Central Railroad by deed recorded in the
 office  of the Clerk of Albany County in Book 1688 of Deeds at Page 25 a
 distance of 217.95 feet; thence southerly making an  interior  angle  of
 58°  04'  with the last described course and along the west line of said
 lands a distance of 234.89 feet to the north line of  Manning  Boulevard
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

 North (a/k/a Manning Boulevard) a distance of 93.73 feet to the point or
 place of beginning.
   §  3.  The  description  in  section two of this act of the land to be
 conveyed is not intended to be a legal description but  is  intended  to
 identify  the  parcel  to be conveyed.   As a condition of the transfer,
 KIPP: Albany Community  Public  Charter  Schools  shall  submit  to  the
 commissioner  of general services, for his or her approval: (i) an accu-
 rate survey and description of the lands to be conveyed,  which  may  be
 used  in  the  conveyance  thereof;  and  (ii)  a  site plan showing the
 improvements necessary to carry out the public  purposes  set  forth  in
 section five of this act.
   §  4.  The office of general services shall not transfer or convey the
 land described in section two of this act unless application is made  to
 the  office of general services by KIPP: Albany Community Public Charter
 Schools, such application shall be  made  within  two  years  after  the
 effective  date  of  this  act.  The transfer or conveyance of such land
 shall be made within one year after KIPP: Albany Community Public  Char-
 ter Schools submits the application to the office of general services.
   §  5.  Any  lands  transferred  pursuant to this act shall be used and
 improved solely for the purposes of improving traffic flow at an  appur-
 tenant  public  school  facility  for  the benefit of the school and the
 neighborhood and to provide public parking and trail access  in  support
 of  the  adjacent  Tivoli Lake Preserve owned by the city of Albany, and
 upon termination of such use, title to the lands  so  transferred  shall
 revert to the state of New York.
   §  6.  This  act shall take effect immediately and shall expire and be
 deemed repealed 3 years after such date.
