BILL NUMBER: S9095 SPONSOR: RAMOS TITLE OF BILL: An act to amend the labor law, in relation to authorizing the department of labor to use electronic storage technology to store public records, papers, documents and matters required by law to be recorded 1. PURPOSE: To update the Labor Law to allow the Department to use current technolo- gy to record and maintain public records, papers, documents or matters required by law to be recorded. 2. SUMMARY OF PROVISIONS: This proposal would amend Labor Law § 35(1) to replace the term "optical disc" with "electronic storage." 3. EXISTING LAW:

RAMOS -- (at request of the Department of Labor) -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to authorizing the department of labor to use electronic storage technology to store public records, papers, documents and matters required by law to be recorded THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 35 of the labor law, as added by chapter 138 of the laws of 1991, is amended to read as follows: 1. The department is authorized and empowered to use [optical disc] ELECTRONIC STORAGE technology to record and maintain public records, papers, documents or matters required by law to be recorded. Such records shall be capable of being copied, photographed, or microphoto- graphed by a process which accurately reproduces the original thereof in all details. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13743-01-2
