 AN ACT to amend the social services law, in relation  to  the  automatic
   reinstatement  of  public assistance following the completion of resi-
   dential drug treatment

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The social services law is amended by adding a new section
 131-y to read as follows:
   § 131-Y. AUTOMATIC REINSTATEMENT OF PUBLIC  ASSISTANCE  FOLLOWING  THE
 COMPLETION OF RESIDENTIAL DRUG TREATMENT. 1. ANY INDIVIDUAL WHO HAS BEEN
 PLACED  IN  A MANDATED RESIDENTIAL TREATMENT FACILITY AND HAS HAD HIS OR
 HER PUBLIC ASSISTANCE SUSPENDED AS A RESULT OF SUCH PLACEMENT SHALL  NOT
 BE  REQUIRED  TO  REAPPLY  FOR PUBLIC ASSISTANCE WHEN SUCH PLACEMENT HAS
 ENDED AND SHALL BE AUTOMATICALLY REENROLLED IN BOTH A CASH AND  NON-CASH
 PUBLIC ASSISTANCE PROGRAM BEGINNING ON AND AFTER THE DAY OF RELEASE FROM
 SUCH FACILITY.
   2. RESIDENTIAL TREATMENT FACILITIES SHALL WORK IN CONJUNCTION WITH THE
 DEPARTMENT  TO  PROVIDE  THE NECESSARY SERVICES AND ASSISTANCE TO ENSURE
 SUCH INDIVIDUALS WHO REQUIRE  THE  REINSTATEMENT  OF  PUBLIC  ASSISTANCE
 AFTER  RELEASE  FROM A FACILITY PURSUANT TO THIS SECTION ARE RE-ENROLLED
 IN CASH AND NON-CASH PUBLIC ASSISTANCE PROGRAMS PRIOR TO  THEIR  RELEASE
 FROM SUCH FACILITY.
   § 2. This act shall take effect immediately.
