SHRESTHA -- read once and referred to the Commit- tee on Health AN ACT to amend the social services law, in relation to notification of changes to the model contract with managed care providers under the medical assistance program and requiring the department to post certain changes on its website THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (d) of subdivision 2 of section 364-j of the social services law, as added by a chapter of the laws of 2022 amending the social services law relating to notification of changes to the model contract with managed care providers under the medical assistance program, as proposed in legislative bills numbers S. 9207 and A. 9442-A, is amended to read as follows: (d) Whenever the commissioner of health makes changes to the terms, conditions or time frames contained in the model contract THAT SERVES AS THE BASIS FOR CONTRACTS with managed care providers in the managed care program under this section, [public notice detailing] the changes shall be [provided] POSTED on the department's website [and through publica- tion as a public notice in the state register]. THE DEPARTMENT SHALL POST ON ITS WEBSITE ANY CHANGES REQUIRED TO BE SUBMITTED TO THE CENTERS FOR MEDICARE AND MEDICAID SERVICES (CMS) FOR APPROVAL prior to [finaliz- ing such changes or submitting the amended contract to the Centers for Medicare and Medicaid Services for approval, if required. This public notice shall also apply to] SUBMISSION OF THE CHANGES. A SUMMARY OF ANY CHANGES SHALL ALSO BE PUBLISHED IN THE STATE REGISTER. A NOTIFICATION OF any request for proposals issued by the department for managed care providers to participate in the managed care program SHALL ALSO BE PUBLISHED IN THE STATE REGISTER. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2022 amending the social services law relating to notification of changes to the model contract with managed care providers under the medical assistance program, as proposed in legislative bills numbers S. 9207 and A. 9442-A, takes effect.
