 AN ACT to amend the education  law,  in  relation  to  allowing  medical
   assistants to draw and administer immunizations to patients in certain
   supervised settings
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 6909 of the education law is amended  by  adding  a
 new subdivision 12 to read as follows:
   12.  NOTWITHSTANDING  SUBDIVISION  SEVEN OF SECTION SIXTY-FIVE HUNDRED
 NINE OF THIS TITLE, A CERTIFIED NURSE PRACTITIONER MAY  DIRECTLY  ASSIGN
 AND  SUPERVISE  A  MEDICAL ASSISTANT, IN AN OUTPATIENT SETTING, WITH THE
 TASK OF DRAWING AND ADMINISTERING IMMUNIZATIONS  TO  PATIENTS,  PROVIDED
 THAT  SUCH  MEDICAL  ASSISTANT  RECEIVES  APPROPRIATE TRAINING FROM SUCH
 CERTIFIED NURSE PRACTITIONER AND PROVIDED FURTHER  THAT  SUCH  CERTIFIED
 NURSE  PRACTITIONER SHALL BE RESPONSIBLE FOR THE ACTIONS OF SUCH MEDICAL
 ASSISTANT.
   § 2. Section 6527 of the education law is  amended  by  adding  a  new
 subdivision 12 to read as follows:
   12.  NOTWITHSTANDING  SUBDIVISION ELEVEN OF SECTION SIXTY-FIVE HUNDRED
 THIRTY OF THIS TITLE, A  LICENSED  PHYSICIAN  MAY  DIRECTLY  ASSIGN  AND
 SUPERVISE  A  MEDICAL ASSISTANT, IN AN OUTPATIENT SETTING, WITH THE TASK
 OF DRAWING AND ADMINISTERING IMMUNIZATIONS TO  PATIENTS,  PROVIDED  THAT
 SUCH  MEDICAL ASSISTANT RECEIVES APPROPRIATE TRAINING FROM SUCH LICENSED
 PHYSICIAN AND PROVIDED FURTHER THAT SUCH  LICENSED  PHYSICIAN  SHALL  BE
 RESPONSIBLE FOR THE ACTIONS OF SUCH MEDICAL ASSISTANT.
   § 3. This act shall take effect immediately.
