BILL NUMBER: S2028 SPONSOR: ADDABBO TITLE OF BILL: An act to amend the real property tax law, in relation to establishing a real property tax exemption for veterans who have a one hundred percent service connected disability PURPOSE OR GENERAL IDEA OF BILL: To establish a real property tax exemption for veterans with a 100 percent service connected disability. SUMMARY OF PROVISIONS: Amend the real property tax law by adding a new subdivision 3-a which would mandate an exemption from all taxes imposed upon disabled veterans and his or her spouse, with a one hundred percent service connected disability. 2. effective date changed

ADDABBO, HARCKHAM, RAMOS, STEC, WEIK -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Security and Military Affairs AN ACT to amend the real property tax law, in relation to establishing a real property tax exemption for veterans who have a one hundred percent service connected disability THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 458 of the real property tax law is amended by adding a new subdivision 3-a to read as follows: 3-A. REAL PROPERTY OWNED BY A DISABLED VETERAN WHO HAS A ONE HUNDRED PERCENT SERVICE CONNECTED DISABILITY, AND HIS OR HER SPOUSE, AND CONSTI- TUTING THE PRIMARY RESIDENCE OF SUCH PERSONS SHALL BE DEEMED FULLY EXEMPT FROM ALL TAXES IMPOSED UPON SUCH PROPERTY BY A MUNICIPAL CORPO- RATION. § 2. A COUNTY, CITY, TOWN, VILLAGE OR SCHOOL DISTRICT MAY ADOPT A LOCAL LAW OR RESOLUTION TO INCLUDE THE PRIMARY RESIDENCE OF ANY SERIOUSLY DISABLED VETERAN WHO: (A)(I) WAS DISCHARGED OR RELEASED THEREFROM UNDER HONORABLE CONDI- TIONS; (II) HAS A QUALIFYING CONDITION, AS DEFINED IN SECTION ONE OF THE VETERANS' SERVICES LAW, AND HAS RECEIVED A DISCHARGE OTHER THAN BAD CONDUCT OR DISHONORABLE FROM SUCH SERVICE; OR (III) IS A DISCHARGED LGBT VETERAN, AS DEFINED IN SECTION ONE OF THE VETERANS' SERVICES LAW, AND HAS RECEIVED A DISCHARGE OTHER THAN BAD CONDUCT OR DISHONORABLE FROM SUCH SERVICE; AND (B) (I) IS CONSIDERED TO BE PERMANENTLY AND TOTALLY DISABLED AS A RESULT OF MILITARY SERVICE; (II) IS RATED ONE HUNDRED PERCENT DISABLED BY THE UNITED STATES DEPARTMENT OF VETERANS AFFAIRS; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

Pass this bill. It will help veterans
Atleast 18 other states offer this benefit and NY wonders why people keep leaving. We have money for everyone else but our Veterans. This comes up yearly and never gets thru. A shame....

Please pass this fast or we will be forced out of New York. Since I’ve bought my home my taxes have been raised three times. This is criminal. I wrote a blank check to America with my life and now I’m severely injured and can’t work. When we bought the house it was affordable but these tax hikes have been pushing us out. The local news is interested but we need to give them a chance to pass this first.
