BILL NUMBER: S5818 SPONSOR: MYRIE TITLE OF BILL: An act to amend the election law, in relation to the dates to file a designating petition; and providing for the repeal of such provisions upon expiration thereof PURPOSE OR GENERAL IDEA OF BILL: The act would change the dates of petition filing to allow observant Jewish candidates and staff to file without interfering with Passover. SUMMARY OF PROVISIONS: Section 1 amends section 6-158 of the election law by extending the designated filing period from April 6, 2023 to April 10, 2023. Section 2 amends section 6-134 of the election law providing that any signature made earlier than forty-one days before the last day to file designating petitions for the primary election shall not be counted.

Section 6-158 of the election law is amended by adding a new subdivision 1-a to read as follows: 1-A. NOTWITHSTANDING THE TIME FIXED IN SUBDIVISION ONE OF THIS SECTION, FOR THE YEAR TWO THOUSAND TWENTY-THREE, SUCH DESIGNATING PETI- TION REQUIRED TO BE FILED BY SUCH SUBDIVISION SHALL BE FILED NOT EARLIER THAN THE THIRTEENTH MONDAY BEFORE, AND NOT LATER THAN THE TWELFTH MONDAY PRECEDING THE PRIMARY ELECTION. § 2. Section 6-134 of the election law is amended by adding a new subdivision 4-a to read as follows: 4-A. NOTWITHSTANDING THE TIME FIXED IN SUBDIVISION FOUR OF THIS SECTION, FOR THE YEAR TWO THOUSAND TWENTY-THREE, A SIGNATURE MADE EARLI- ER THAN FORTY-ONE DAYS BEFORE THE LAST DAY TO FILE DESIGNATING PETITIONS FOR THE PRIMARY ELECTION SHALL NOT BE COUNTED. § 3. This act shall take effect immediately and shall expire December 31, 2023 when upon such date the provisions of this act shall be deemed repealed.
