 AN  ACT  to  amend  the public authorities law, in relation to providing
   reimbursements to sworn officers of  the  metropolitan  transportation
   authority police department non-revenue E-ZPasses

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public authorities law  is  amended  by  adding  a  new
 section 1270-k to read as follows:
   § 1270-K. TOLL REIMBURSEMENT. 1. FOR THE PURPOSES OF THIS SECTION, THE
 TERM  "SWORN  OFFICER  OF THE METROPOLITAN TRANSPORTATION POLICE DEPART-
 MENT" SHALL INCLUDE EVERY SWORN POLICE OFFICER, THE CHIEF OF POLICE, THE
 DEPUTY CHIEF, CAPTAINS,  LIEUTENANTS,  AND  SERGEANTS  EMPLOYED  BY  THE
 METROPOLITAN TRANSPORTATION AUTHORITY.
   2.  EACH  SWORN  OFFICER  OF  THE  METROPOLITAN  TRANSPORTATION POLICE
 DEPARTMENT SHALL BE ENTITLED TO A NON-REVENUE  E-ZPASS  OR  A  SUCCESSOR
 DEVICE  EXCLUSIVELY  FOR COMMUTATION ONLY. UNLESS OTHERWISE DEFINED IN A
 REPRESENTED MEMORANDUM OF AGREEMENT WITH THE AUTHORITY, EACH SWORN OFFI-
 CER OF THE METROPOLITAN TRANSPORTATION POLICE DEPARTMENT SHALL SURRENDER
 SUCH OFFICER'S E-ZPASS UPON RETIREMENT, RESIGNATION OR TERMINATION.
   § 2. This act shall take effect immediately.
